Former Padres, Storm player named in rape suit

LOS ANGELES - A teenager who claims she was raped while on a plane from New Zealand sued Qantas and a pitcher who eventually made it to the San Diego Padres and has a tryout this spring with the Anaheim Angels.

Angela Rogers, whose sexual battery and assault lawsuit was filed late yesterday in Los Angeles Superior Court, is asking for an unspecified sum of money.

Now 18, Rogers claims she was sexually assaulted Jan. 25, 2001 by Eric Cyr -- a Montreal native who at the time was playing for the Lake Elsinore Storm, a San Diego Padres minor league affiliate -- as the two traveled to Los Angeles on Qantas Flight 25.

She also names Qantas Airlines and the Padres and the Storm as defendants, primarily for alleged negligence.

Cyr pleaded guilty to a misdemeanor count of sexual contact with another without consent stemming from the incident and served 30 days in jail in 2001. He also was sentenced to a year's probation and 250 hours of community service.

Cyr, who was returning home after playing winter ball in Australia, was suspended by the Storm in the spring of 2002, but returned later that season.

Cyr, who later made it to the Padres, could not be reached for comment. A media representatives for the big club in San Diego did not return a call for comment.

Media director Tim Mead of the Anaheim Angels, which recently extended an invitation to Cyr for spring training, said "the issue has been dealt with between Eric and the legal system."

Cyr, a 24-year-old lefthanded pitcher, appeared in five games for the Padres in 2002, compiling an 0-1 record with a 10.50 earned run average.

Rogers claims she was seated next to Cyr on the Qantas flight, according to the suit.

She alleges that Cyr made "unwanted and improper sexual advances ... despite being repeatedly advised she was a minor," the suit states.

According to the suit, Cyr allegedly handed Rogers a note that read "what's up sexy, you are very cut (sic) it is bad that you are 15 the law is very strick (sic) about that kind of stuff but I may have to do an execption (sic) this time ..."

Rogers alleges Cyr "tricked" her into accompanying him to the plane's bathroom, then "began to engage in un-consented sexual relations" with her, the suit states.

Rogers claims Cyr raped her for 30 minutes, according to the suit.

She also claims Qantas employees should have been suspicious because the bathroom was occupied that long, according to the suit.
