Vista approves hiring law on day laborers

VISTA -- While congregating in and around City Hall on Tuesday, demonstrators on both sides of the national illegal immigration debate said that the Vista City Council's unanimous approval of an ordinance to regulate the hiring of day laborers could have broad implications.
The ordinance, which takes effect July 28, will require those who hire off-site day laborers to register with the city, display a certificate in their car windows, and present written terms of employment to workers. Critics have called it a transparent attempt to eliminate hiring sites for day laborers.
"You're putting Vista in the eye of the storm," resident Dick Eiden cautioned the council before the vote. "A big national storm."
But several opponents of illegal immigration asked the council to set an example for other cities and approve the ordinance.
"We need to take care of our own people, our own citizens," said Anthony Porrello of San Diego.
City leaders chafed at comments from some speakers that this was an issue of race. City Attorney Darold Pieper said the "whole thrust" of the ordinance was that it would protect workers from unscrupulous employers.
With activist groups on both sides announcing plans to demonstrate before and during the meeting, law enforcement had a large, visible presence around City Hall. A metal detector was used to scan the more than 100 people who filed into the council chambers for the vote.
Sheriff's Capt. Glenn Revell said more than 100 Sheriff's Department deputies and detectives from as far away as Alpine and Imperial Beach were positioned in the area. The department had expected 200 to 400 demonstrators, but at its peak, Tuesday's crowd only hit about 150, Revell said.
"We would rather have more resources than we need then need resources and not have them," Revell said.
When demonstrators started to disperse around 8 p.m., there had been no incidents, Revell said.
Anti-illegal immigration activists made their first appearance around 4 p.m., waving homemade signs and American flags around City Hall.
"This is where the action is today," said Loch Crane, a retired teacher from Ocean Beach who said he is part of the Minuteman Project.
Mike Spencer, a local anti-illegal immigration activist, said he wanted to send a message that "citizens everywhere are getting fed up with illegal immigration."
A half-mile away, a pro-immigration rally took shape in a parking lot on Escondido Boulevard just north of Santa Fe Avenue where day laborers gather most mornings looking for work. A peaceful crowd of about 40 people had gathered by 4:30 p.m. in a tight knot under the shade of a few trees lining Escondido Boulevard. The guitar players sang songs of protest in Spanish, as men and women milled about on the sidewalk and in the grass waving at passers-by holding signs that read "Vista, you're buying trouble" and "Humans are not illegal."
"On the 27th of June we're going to protest and march," sang Joaquin McWhinney, one of The People's Troubadours ---- a name Ramon "Chunky" Sanchez made up on the spot. "We're not bad people. This country needs us. We're here to work and support it."
In a quick survey, the majority of people came from outside of Vista. The number of white and brown faces were about equal.
The Rev. Margo McKenna of the Chalice Unitarian Universalist Church in Escondido said she identified with the day laborers.
"I'm here because I'm a child of German immigrants who came here illegally to get away from the (World War I)," she said. "If they didn't have a chance to farm in Montana, I wouldn't be here now."
Joe and Marsha LoMedico, owners of the Sons of Italy Pizzeria, said the use of the parking lot by the laborers could be disruptive.
"Yeah, they pee back behind the building here, they litter," Joe LoMedico said.
"They chase cars," Marsha LoMedico added, noting that the clientele of the shopping center that includes Vons, a nail salon and a fabric store attracts mostly women and children.
"They don't want to see that, and they don't want to come here," Marsha LoMedico said.
However, the couple said they own another pizzeria by Rancho Buena Vista High School and have the same problem ---- except it's high school kids loitering.
"Nobody ever talks about that," Joe LoMedico said.
A clerk at the Salvation Army said recent confrontations between anti-illegal immigration activists and the day laborers scare her more than the day laborers themselves.
At 5:30 p.m. the protesters walked north on Escondido Boulevard toward City Hall chanting slogans, singing songs and waving signs under the watchful eye of the sheriff's deputies. At City Hall, the two opposing sides were cordoned off onto two sections of sidewalk.
After the meeting, Claudia Smith, a migrants-rights activist, said she hoped the ordinance had "sufficient legal infirmities" and would never take effect.
David Blair-Loy, legal director of the American Civil Liberties Union in San Diego and Imperial Counties, said before the meeting that the ordinance may be unconstitutional and is being carefully scrutinized.

Myself, and all of you pay $40,000 a year per head then when there done serving there time we give them money small I know and then pick the bill up to deport them for them just to hop are fence again. I don't need cheaper flowers, fruits or vegetables, I need security for my family from illegal illegals. I'm not racist and if you haven't been to mexico say a border town they don't care how they live. Some of you might think otherwise but thats probably cause your landscapers are nice, but believe me they are not the majority. Illegals are stealing are country from us. They will work for less even when they become legal because they don't mind sharing a room with6 others so they will take less $ and that means your job to is up for grabs because employers are out mostly for themselves and their familys(nothing wrong with that). This has to stop and we need to regulate are law and find all illegals( all nationalities) fine them and kick them out for good. That way we can reward those who have waited for so long to do it the right way and let them come over with jobs awaiting. As it stands, there are many employment opportunities being stolen by illegal immigrants that do contribute back to society. The only people that want them here, feel that way for selfish reasons. It is that they either have illegal relatives or they benefit by the illegal cheap labor. This approved law is a baby step, which will prbably have a minimal effect. The good law-abiding (other than being here illegally) illegal immigrants will work hard and find a way to become citizens while the criminals will be screened and deemed unacceptable for entry. I don't see why this is such a problem. It probably only a problem because we turned a blind eye for so long. We are eventually going to have to deal with the corrupt Mexican government to help straighten out our neighbor. Mexico is due for a revolution, I don't know why the illegals are so determined to revolt against the United States instead. They have many of the same resources in their country. They just need a little help taking their country back for the people. President Fox is a drug dealer, pimp, and thief.

America has helped allot of countries including Mexico, the illegal alien worker has been around for a long time. When Illegal Aliens begin to take over complete communities and start changing laws, some may feel it has gone too far. If the laws of this country are continual ignored I would suspect that the American citizens will finally wake up and begin to first VOTE! Second really want to learn what is happening in California, Arizona and Texas. I would also suggest most states will not want to go along with what California and other sanctuary cites\communities are doing. This is just the beginning of the change back from a lawless condition being corrected because our Federal Government is doing nothing. Bottom line Laws should be enforced or removed the present condition is only going to get worse for all of us. A person standing around shopping malls to get work is not a proper way of getting employment in this country. There must be a better way; Vista is attempting to find a better way to do this. If you are a legal citizen or legal foreign worker what do you care how you get hired as long as you get paid should be the important point. Give these businesses back their parking lot, apply to become a legal citizen/worker in America or please leave.

I am a "liberal Democrat" and have been against illegal immigration since it first started impacting our schools and social services- 20 years ago! Most of the people I know are passionatle anti-illegal immigration, so I don't know who the h--- the Democratic Party is listening to!!! We are NOT the lifeboat for Mexico and Central and South America. This issue killed Francine Busby, and it should have! If you are soft on immigration, my "liberal" vote goes to the other guy of whatever party. After this big problem is fixed, we can move on to other issues.

Everybody wrote on Jun 28, 2006 9:14 AM:Everybody should follow the law!! Good job VISTA... Employers now hide behind the toothless Federal Laws passed by "christian - conservatives". If congress had enough guts and brains to set up a computer based system where employers were REQUIRED to check the legal status of anyone they hired under penalty of say, $1,000 per day per violation, we would have no undocumented problem. This would save us the $$$ we spend on building and maintaining fences. I for one would be willing to have a NATIONAL ID CARD to prove my legal status.

Seems to me they are not illegal immigrants as much as they are undocumented guests, since we knew full well people were crossing the border on a regular basis and did nothing to stop the flow.I have serious doubts that any of those that own a business and say they want the so called illegal immigrants to be deported would prevent them from spending their money in their establishment. I also have little doubt that many who speak out against our "undocumented guests" take advantage of their being here and have never asked their gardener or housekeeper for proof of legal residency. Here's an idea, let's all meet for margaritas at a local Mexican restaurant so we can talk about how to get rid of the Mexicans.

It's embarrassing to think that this is what we have to show for millions of tax dollars spent on educating folks! It remains to be seen whether or not the decision of the Vista City Council will amount to anything. They have made a half-hearted attempt by this recent action. We are a country of wimps, and Mayor Vance and his flock are a great example of our local elected officials' reluctance to stand up for the rule of law, even in a nation frantically treading the waters of political corruption to somehow preserve the sovereignty of the United States of America. Have another hit, Harry! What a waste of a human being.

Hopefully, Mexicans will not be cowed by scare tactics and will get this new leadership. What Americans really need is for Mexico to be fair to Mexicans. And, we need to take back our own government too. Our government is attempting to sell out the American worker by seeking to allow a huge jump in legal immigration in the McCain-Kennedy immigration bill. Some have estimated that there will be 100 million more LEGAL immigrants in 20 years under this bill. And, it allows a HUGE increase in H1B visas - which allows foreigners to come in and take our best jobs and drive down wages. Our government also does the American worker no favors when it negotiates trade laws that put our businesses and workers at a disadvantage. This is trade union busting tactics. If we need cheap workers for our farms so that they won't go out of business - maybe we need to go back to how taxes were collected before the federal income tax started in the 1920's. Then we got our tax income from tariffs. Tariffs provide a huge protection to American business. We could protect our farms with tariffs. Then, an absence of below-minimum wage workers would no longer be a problem because Americans would buy produce from American farms.
