Escondido councilwoman proposes banning rentals to illegal immigrants

ESCONDIDO ---- Taking her cue from similar efforts in other cities around the nation, Councilwoman Marie Waldron is proposing that Escondido adopt a city ordinance that would prohibit landlords from renting to illegal immigrants.
Waldron said last week that she wants the city to look into drafting a law that would fine landlords $1,000 for renting or leasing property to undocumented immigrants, and possibly include arrest for extreme violators.
"I don't want it (the ordinance) to be a slap on the wrist," Waldron said.
Waldron, who has regularly pushed for cracking down on illegal immigration, said that prohibiting undocumented immigrants from renting in the city was a response to federal border control efforts, which she believes have failed.
"It's something every city needs to consider," Waldron said of her proposal, which would follow a Pennsylvania city's tentative approval of a similar measure. "It's just a matter of having the political will."
A rental ordinance would place Escondido square in the middle of an ongoing national debate over illegal immigration, and potentially put the city and landlords in a costly position.
City Manager Clay Phillips said he is not sure the city can legally restrict rental agreements. But even if it can, any resulting ordinance would require additional spending and employee time to enforce it for each of the 20,500 rental units in the city.
"Certainly, we're not geared up for that," Phillips said. "We don't have the resources to try to monitor every single rental agreement in the city at this point."
Landlord and fair-housing advocates, meanwhile, said such an ordinance would unfairly burden property owners, and would never pass legal muster.
State and federal fair housing laws prohibit landlords from refusing to rent to anyone based on several categories, including race, religion and national origin.
Requiring a landlord to verify an applicant's legal status would be in violation of those laws, said Robert Pinnegar, executive director of the San Diego County Apartment Association, a trade group representing 2,800 property owners and managers throughout the county.
"If you have a local ordinance that flies in the face of state and federal fair housing laws, that's an issue," Pinnegar said. "Anything of this status that ties our hand would really concern us from the standpoint of not being able to do our job, or worse, putting us at risk (of lawsuits)."
Public housing agencies regularly ---- and legally ---- demand proof of citizenship or legal residency from applicants for government-subsidized housing programs, according to officials with the Fair Housing Council of San Diego.
Private landlords, however, would be in violation of the law if they did the same, especially if they required information about residency status only from those applicants they suspected of possibly not being citizens or legal residents, according to David Kline, an attorney with the council.
"If housing providers, based on this ordinance, were to check Social Security numbers or verify the immigration status of applicants from one country and not another, it wouldn't be a very difficult argument to prove that is national origin discrimination," Kline said. "And that is the likely outcome of an ordinance like that."
Some cities, however, are determined to test the waters, and Waldron said she has carefully watched their efforts.
Last month, Hazleton, Pa., passed its own ordinance aimed at cracking down on illegal immigration in the town of 31,000 residents. In addition to fining landlords who rent to undocumented immigrants, the law also would deny business licenses to companies that hire illegal immigrants and establishes English as the city's official language.
Hazleton's council is scheduled to vote on the measure for its second, and final, reading, this week.
Some residents in San Bernardino have proposed a similar voter initiative for their city. But their efforts were put on hold last month, after a Superior Court judge said supporters needed to gather more signatures in order to place the proposed law on the November ballot.
Other cities have passed measures taking on different issues related to illegal immigration.
Just down the road from Escondido, Vista's City Council unanimously passed an ordinance last month requiring employers who hire day laborers to register with the city.
Waldron said she sees the rental ordinance as the first piece of a patchwork of potential local immigration laws, that could include making English the official city language, among other elements.
The councilwoman, who is up for re-election this fall, said she plans to bring the rental ordinance idea to the full council later this summer to gauge her colleagues' support.
Previously, Waldron won votes from two other council members in her efforts to back a proposed ballot initiative that would have created a state border police to supplement federal immigration enforcement. The initiative failed to garner enough signatures to make it onto the June ballot.
Councilman Sam Abed said he would be "very supportive" of a ban on renting to illegal immigrants, so long as it doesn't violate the rights of property owners. Such an ordinance, he said, would allow the city to focus on providing language classes and other services that aid the city's poorest legal residents.
"When we say stop illegal immigration, it has to be part of a system," Abed said. "At the same time, you have to be able to help the existing, legal residents in our city."

Landlords already charge prospective renters a fee to run a credit report - charge one to run a Social Security check, too - turnaround time usually 2-3 days. This is totally feasible! To stay within the non-descrimination parameters - run one on everybody.

If someone from Kenya here legally applied for a rental and was denied, that would be against the law. Landlords now can deny someone a rental if the person has a criminal record or violates the law while residing in the rental unit. Folks, read your leases and rental agreements. The City of Escondido is "well within" it's authority to restrict or set regulations on landlords through business licenses which ALL landlords must have. The key word here is "legal". Marie, good job!

In most of these neghborhoods the career criminals, the gang-bangers and dealers, are born US citizens. (would mind being able to kick that trash out fo the country) But illegal immigrants risk getting deported when they are caught breaking the law. They have the most to loose, they are here to work as much as they can and stay under the radar. By the way whose is going to move into these neighborhoods where 'illegals' get evicted, just curious? Going to have to do better than that to find a solution.

My understanding is that he isn't an attorney and that in any case Escondido has a City Attorney. His "can't do" attitude may put him in the running for bureaucrat of the year. The typical bureaucratic stand that he gets paid for showing up for work and anything additional would require added funds, may cement the award. That he gets paid almost $250,000 per year to have such a negative attitude only adds to his bureaucratic credentials. It is no wonder that that Escondido has so many problems when its top administrative official has such a negative attitude.

The associated violence and drug use can only lower the value of the apartments. The Police are uncomfortable going into these projects due to the tenants. Imagine what it is like to collect the rent. In areas with lots of apartments the landlords are stuck renting to illegals because there is already a high illegal presence in other complexes. The landlords could get the same rent from a better set of tenants if all of them could reject illegals based on this law. The value of the apartment complexes would rise and the value of the surrounding houses would likely rise even more. Our children who are just starting out in life could live in Escondido in reasonably priced apartments in their hometown. Today they are driven to other areas since many of the local apartment complexes are so undesirable. It seems like, win, win, win.

BTW, Mayor Baretta of Hazelton, PA has been on many TV/radio shows and is receiving virtually total and monolithic support for his common sense, anti illegal alien/rule of law proposals. Escondido's Mayor Lori Holt Pfeiler, on the other hand, is part of the problem or disease. It is, for the most part, because of her pro illegal alien policies over the yrs that Escondido now has a countywide reputation for being a mini Tijuana replete w/viscious Latino gangs, frequent stabbings, murders, rapes, lowest per capita income in the county, gross overcrowding in apartments, lots of subsidized housing, and some of the worst schools in the state and nation. Mayor Pfeiler has made Escondido a sanctuary city for illegal aliens and their criminal activities, much to the dismay and horror of law abiding, tax paying citizens. Mayor Pfeiler is a cancer that is destroying our once safe and beautiful community. Mayor Baretta and Councilwoman Waldron are the cure. Vote Pfeiler out this November! She's done enough damage, and we citizens can no longer afford her dangerous ways.

With no place to live and work, their children won't be overcrowding our schools. The EUHSD won't have to consider floating a huge bond measure to build more schools at property tax paying citizen expense. Yes, we can clean up the grafitti in the hopes that the guests will flock to our beautiful new hotel, but we have to do more. The city has to attack the problem at the roots, one local law at a time to slowly make Escondido an unwelcome place for illegal immigrants to both live and work. His vote on the California Border Patrol initiative was NO and was accompanied by rhetoric which inferred that all the police, CHP's and sheriffs in San Diego County were, Keystone Kops. The Mayor said that even thinking about illegal immigration is not my job, and voted NO. Council Member Waldron is clearly taking the lead. Perhaps she should run for Mayor this time around – someone certainly should run whose goals and objectives are more clearly aligned with the voters than the Mayor’s. Clearly the current Mayor is out of touch with the wishes of the legal citizens of Escondido on this and other issues. The two individuals who have to step-up on this issue are Council Member Abed and Mayor Pro Tem Gallo. The article makes it sound like Mr. Abed is a supporter. His criteria that existing, legal residents be helped are the chief reasons for implementing this proposal as well as future proposals. We can hope that Mr. Gallo will back this and other proposals. It is time to be decisive and not hide behind potential problems (those always exist). It is one of those times for leadership and bold action which don’t occur very often – a real opportunity for those in public office to make the right decisions on key, tough issues which really affect the community.

Dennis wrote on Jul 9, 2006 10:47 AM:If landlords are forced to check the citizenship of ALL prospective renters, the arguement of racial bias goes out the window. A density law that limits the number of persons that can reside in a dwelling based on bedroom count would also be helpful, as well as requiring that all inhabitants be listed on the lease. This problem didn't occur overnight, and it will take many small steps like this to remediate.

The Mayor is expected to try to sabotage the measure. Since it is apparent that the Mayor already has the City Manager on board against this, it is likely just a matter of time before the City Attorney opines that this is illegal. The timing of this proposal is great. Waldron, Newman, and the Mayor are up for reelection this fall. Illegal immigration is a hot button political issue this year and Newman and the Mayor will need to take a side. The Mayor is a big supporter of Congressman Brian Bilbray and his key issue has been illegal immigration. He is also up for reelection this fall. It would be great for Congressman Bilbray to support a Federal law prohibiting renting to illegals. Now that would be comprehensive immigration reform! In the meantime, it is time for Congressman Bilbray to take a stand on this issue of renting homes to illegal aliens in his district!

Escondido is well known all over Mexico as one of the best places to hide out and take advantage of America's hospitality. The name alone of our city in Espanol means hidden as in hide out or hide away. In Escondido you can live, shop, send your kids to the public schools for free and they will even teach them Spanish. If you are a single mom you can even collect welfare and not have to work outside of your home. There are plenty of apartments with swimming pools and parks for your children. And your children can have a free lunch and breakfast at any public school. Just make sure you give labor on the U.S. side of the border. Escondido is a paradise for illegals. Wouldn't you agree? Perhaps things would be different if Escondido could attract legal Americans to live, shop and play in a beautiful city that just got a movie theater. Escondido use to be a place where people retired or came to raise a family. Unfortunately it is now known as the best place to be an illegal immigrant or raise a family if you are an illegal immigrant. Escondido is the Roswell, Texas for illegal aliens. Can the mayor and city council do a better job of attracting businesses and developments that do not take advantage of the illegals? Maybe then Escondido can become a desirable place to live for the those of that called it our home town.

Since there is an inadequate paper trail, law enforcement would need implement 24 hour surveillance of a known illegal immigrant to prove employment. Right now, just about every canyon and pepper tree in the County has an illegal immigrant encampment. Those here for several years finally find housing in an apartment by sharing expenses with several other illegal immigrants. The apartment requires a relatively long commitment--at least a month--often 6 months or more. Effective enforcement can take place anytime during that time period. Having enforcement related to housing may be much more effective in enforcing policies against illegal immigration. Every new program will have unforeseen issues that may need to be addressed in the future. The program to prevent renting to illegal immigrants will be no different. A sub-optimal program is better than the current totally ineffective program.

Preferential treatment is being given to people with children.... isn't that discrimination? My family size is one--myself. I cannot help but notice that many of the affordable apartments I qualify for have a high percentage of Hispanics living there, as well as a community area which "assists" in English classes, free food for children, etc... I've paid my taxes, why can't I get the affordable hosuing I need? Five families living in a one famly unit... don't tell me that isn't a bunch of illegals living there. I hope this new proposal in Escodndio goes through, then maybe AMERCIANS with disabilties such as myself will be able to find decent, affordable housing again, and not be placed on a waiting list that is brimming with Hispanic last names; and whose current occupents stay in their apartments for years and years with plenty of people (illegals?) moving in in complete and utter diregard of zoning laws.

Most of you are all cruel and heartless well I began to say human beings but I don't think most of you are part of the human race any longer. Not sure what your condition is called but it is along the lines of pure evil. So is the plan to ask every Mexican or brown skinned person who wants to rent a home or an apt. in Escondido for documents proving they are allowed to live in the U.S.? That sounds a lot like racial profiling and housing discrimination. Is Marie Waldron going to pay the attorney's fees the landlords incur because you know there will be lawsuits. It's discrimination wrapped up in a pretty package called concern. It is the Federal governments job to enforce the laws not our little city's to make new ones.

The local police department can check for legal identification when ever they come across a crime, even traffic stops. Some cities have day worker halls were the illegals gather for work.
