Mother seeks justice for daughter killed in crash

LA MESA -- The death of her daughter in a traffic crash that littered a Ramona highway with wreckage has given Melanie Kortlang a new mission.
The 43-year-old La Mesa woman said last week that she now wants justice for her child, 22-year-old Amy Kortlang of Ramona.
She also wants to know how the illegal immigrant arrested for murder after the collision could be here despite previous charges and deportation, Kortlang said.
"How was this (man) allowed to come back ... and do the ultimate, which was kill my daughter?" Kortlang asked rhetorically in a phone interview.
She said no one in government has offered any explanations about how Rafael Ramirez Perez, deported to Mexico earlier this year, was back on the road in Ramona the night of Oct. 16.
That's when Perez, 22 and with no valid driver's license, allegedly caused a four-vehicle crash on Highway 67 that killed Amy Kortlang and injured three other people.
He then walked away, authorities said. Perez was arrested two miles from the accident.
"My goal right now is to keep Amy alive (in memory), and to prevent this from ever happening again," Melanie Kortlang said. "We've got to stop it."
Kortlang said she plans on attending all of Perez's court appearances. Her thoughts about him, she said, are "not Christian."
In addition to murder, Perez is charged with gross vehicular manslaughter and two counts of driving under the influence, plus driving without a license.
There is an enhancement alleging he has had at least three drunken driving convictions within the last 10 years.
If convicted of all the charges, Deputy District Attorney Kristian Trocha said Perez could be in prison for 25 years to life.
Perez is currently being held in county jail with bail set at $1 million, in case an immigration hold on him somehow fails, Trocha said.
California Highway Patrol Officer Brian Pennings said Perez was booked into the jail the same as any other suspect. The jails are operated by the San Diego County Sheriff's Department.
"We screen for birthplace and citizenship of everyone who comes into custody," said Sheriff's Department Capt. Glenn Revell.
He said the information goes to federal immigration authorities. They place jail holds on any suspected illegal immigrants, and those suspects are turned over to them after local cases are completed, Revell said.
Lauren Mack, spokeswoman for U.S. Immigration and Customs Enforcement in San Diego, said after the fatal crash that Perez was handed over to immigration officials earlier this year, after serving time for a drunken driving conviction.
He was deported to Mexico in March, Mack said.
On the night of the crash, Perez was driving his company's work truck when the fatal accident happened on a dark stretch of Highway 67, south of Mussey Grade Road, Highway Patrol officers said.
The company pickup truck veered into the opposite lane and sideswiped a Dodge Caliber before slamming head-on into Amy Kortlang's red Honda Civic. The Honda overturned, and she died at the scene.
Just 18 minutes earlier, Melanie Kortlang said, she had finished some fun text messaging for the night with her daughter, part of their daily communication.
"She had a wonderful sense of humor," Melanie Kortlang said.
The mother recalled her daughter, a cosmetologist who worked at Supercuts in Ramona and at Poway Chevrolet, as a beautiful, responsible young woman "with a smile that would knock your socks off."
"We were at that stage where we confided in one another," said Kortlang.
Her daughter loved her boyfriend of two years, and was on her way to watch him play in a pool tournament in Poway when the crash happened, she said.
Melanie Kortlang and her husband, Robert, also have a 16-year-old daughter, Jessica.
"It's just this emptiness to us," Kortlang said about her oldest daughter's death. "I've never been so sad in my entire life. It's moment by moment. Right now I'm in a tunnel."

I see this happen again and again. My question is When is the govenor going to do something about these atrosities? Since when do we let these illegal immigrants get away with whatever they want with no consequences? I'm appaled! My heart goes out to this family and friends for this loss of life. I don't know this particular female that passed away, but I've remember seeing her around Ramona. The sad thing is there's no retribution behind there actions. It's like no one cares. If your illegal in my country, you shouldn't be driving a car, you shouldn't be working an actual tax paying job and you shouldn't be just "hanging around" looking for work! Heck, these people aren't finger printed and no-body knows who they are. This makes it too easy to get away with breaking the law. I'm very sorry for there loss and I hope this guy (animal) gets punished for what he did...

Demand some answers from the muckie mucks who have allowed our country to become third world nation of lawbreakers. Someone has to be held accountable for this travesty. We need increased interior enforcement of our laws. Deport or lock up these offenders. Who was the illegal driving for? The employer needs to be held responsible for this for hiring the illegal and letting him drive the company truck without a license. Until this money brokering relationship between lobbyists and our elected officials stop we will not see an improvement in illegal immigration. Big business wants illegal immigrants to fill jobs at wages less than what an American sees as reasonable. Do we need to all start living in cardboard shantie towns by the river like these illegals before we start fighting back? Kick out our current elected officials and vote for a change!

Now another citizen killed by a returning individual who has more than one drunk driving offense, driving a company truck, drinking; then killing Mrs Kortlang's beautiful daughter. My sympathy goes out to the family for their unessary loss. Full steam ahead to the mother to campaign to get the undocumented repeat offenders from driving. Also penalize the companies that hire them. God Help this family.

Mary wrote on Oct 31, 2006 10:13 AM:I am hardly for illegal aliens but the real crime here is driving while drunk. If he had previous drunk driving convictions he should have been in jail for that. The fact he is an illegal alien is a secondary offense in this instance. She needs to get active in MADD not the Minutemen. She is fighting the wrong cause. If she has time she can do both, but her daughter could have just as easily been killed by a native born american drunk driver - we have plenty of our own unfortunately.

It's time to do something about the root of the cause: the employers! Stop hiring illegals. Print their names and places of business. If the government won't do anything about it, maybe the Fourth Estate will step up to the plate.

kim wrote on Nov 1, 2006 9:10 AM:i'm terribly sorry for your loss. i fear for my own children every day, when they're out on the road -- not because i'm worried that they'll be killed by an illegal alien, but by a drunk driver. thousands and thousands of people die every year because of drunk drivers -- more than fifteen thousand people in this country alone died in 2005 because of accidents caused by driving drunk. it's too bad that the national status of this one terrible offender has become the focus here, and that the issue of drunk driving (with this man's record, why did the company for which he worked give him the keys to a truck?) takes a backseat, of sorts.

the whole truth wrote on Nov 13, 2006 8:48 PM:Just so everyone knows... He was not hired illegally. He had a valid social security number... it did not become invalid when he was deported. He was on payroll. The employer did what they were suppose to by law. A small business does not usually run background checks on employees. It is a very very sad and a tragic loss of life. This story sadly is taking a new turn for political reasons. The company whose employee this was is not a heartless that disregards the laws. I think our blame should go solely to this individual that got behind the wheel of a vehicle. If someone else is to blame what about this guy's parents? They were home and watched him get loaded and then take off? This vehicle truck was basically stolen. This happened after hours. She could have just as easly been killed with one of the family members vehicle. I think the focus needs to be on the individual who was driving the car. He makes me sick for killing an innocent unsuspecting girl!
