Escondido council supports residential parking restrictions

ESCONDIDO ---- The Escondido City Council has a new plan to deal with the effects of illegal immigration, but this one could affect every Escondidan.

The council said Wednesday evening it supports the creation of parking restrictions on residential streets, including the prohibition of overnight parking, to help solve the city's overcrowding problems.

Every council member except Mayor Lori Holt Pfeiler made it clear during their meeting at City Hall that they want the new restrictions, which would be based on an ordinance already in place in a Northern California city.

"We are trying to improve the quality of life in Escondido," Councilman Sam Abed said.

Abed and other council members have blamed the overcrowding in part on illegal immigrants living here.

Councilwoman Marie Waldron said overcrowded homes that have far more residents than originally intended put a strain on city services such as sewers and sanitation. And many residents can't find parking places near their homes because of the increased number of cars that result from the overcrowding.

An overnight parking ordinance should address these issues, she said.

"I think that will take care of a lot of the problems in our neighborhoods," Waldron said.

After a presentation by city staff members about similar parking ordinances in other cities, the council decided to have its staff hold a public forum on the proposal and begin working on an ordinance that would be modeled after one in Menlo Park by San Francisco Bay.

The Menlo Park ordinance requires residents to pay for on-street parking permits and prohibits parking in residential areas from 2 to 5 a.m., among other restrictions.

The idea to prohibit overnight parking in Escondido was proposed in August during the same meeting at which the council majority ---- Abed, Waldron and Councilman Ed Gallo ---- directed staff members to create a controversial and ultimately doomed ordinance that punished landlords for renting to illegal immigrants.

The rental ordinance sparked demonstrations outside City Hall and brought national media attention to Escondido. It finally was abandoned by the council in the face of a potentially costly legal battle stemming from a lawsuit by the American Civil Liberties Union and other groups.

Some council members referenced the city's previous experience in trying to rid the city of illegal immigrants Wednesday.

"We've got to do this right," said Daniels, who was elected to the council in November. "We can't try anything or do anything that is experimental."

Abed said using the Menlo Park ordinance as a framework should help the city avoid legal issues.

"We have a model that has been ACLU (American Civil Liberties Union) approved, which is good," Abed said.

Pfeiler had many questions about how the new law might work, but didn't voice a strong opinion either way on the parking restrictions. She said the council should recognize that it isn't uncommon for more than one family to buy a house and live there together for economic reasons, which means more cars would have to park at that residence.

"The key piece of information is the housing costs have skyrocketed," Pfeiler said. "We shouldn't be surprised that more people are living in a home."

The mayor also stressed the need for community input before making a decision on the ordinance.

"If you want to have a successful program, you've got to get out there and talk to the community," Pfeiler said.

But not all council members agreed.

Daniels said community input on the details of the new law is important, but he definitely supports the ordinance.

"My interest in community input is not whether (to create the ordinance), but what is the best way," he said.

Gallo said he doesn't want to "belabor the process" of creating the ordinance with too many community discussions, and Abed seemed skeptical about the need for much public input.

"I don't need more community input. I don't need more study," he said. "I drive on the streets every day and I see what the problem is."

The council directed city staff members to have a public forum, which council members wouldn't attend, to get input from community groups and residents. Staff members would bring the results of that forum back to the council for discussion before drafting a parking ordinance.

Mayor Pfeiler's Solution wrote on Mar 29, 2007 1:53 AM:Id like to know what the Mayor's solution is. She is the first to say no but never offers a solution. She ran for Mayor to be the leader for the City, But I have yet to hear her solution for the street parking problems, multi families living in a "single familly home", illegal immegration, unlicensed drivers, crime etc..... Mayor Pfeiler you were elected to lead us, so lead, you're job is more than a ribbon cutter when a new thrift store or 99 cent store opens. Mayor PLEASE help us!

Fix the parking rules and Escondido will be less crowded, safer, cleaner, and more prosperous overnight. The council does not have to reinvent the wheel. The most efficient way for Escondido to proceed would be to utilize a version of the parking rules and regulations other California cities have implemented to limit on-street parking since these methods have already been successfully defended in court. Parking permits for occasional visitors, for occupants of residential units where off-street parking wasn’t required during construction, children have obtained drivers licenses and their own vehicles and for other legitimate hardships can be allocated. Regulations from other cities satisfactorily address all situations which could be raised as legitimate objections by anyone in Escondido. Menlo Park, Pasadena, Cerritos, Claremont, Los Gatos, Fullerton, San Gabriel, Arcadia, Beverly Hills, Brea, and Walnut are some of these cities. Nice areas, communities similar to what Escondido should strive to emulate. The problem is twofold. Groups of families have been allowed to buy single family homes and convert them into illegal multiple dwellings in R-1 zones. City code must be enforced. The real estate brokers involved in the transactions should be sued for damages by the buyers they duped. Also, rental property owners who are abusing the system must be stopped. Logically, if the slumlords cannot provide legal on-site off-street parking for excess tenants and the city does not enable that slumlord by providing on-street parking for their use, the excess tenants causing the overcrowding will vacate the premises. The solution is simple. No on-street parking permits should ever be allowed for residents of multiple family conversions of single family homes in R-1 zones or for excess tenants of slumlords. Landlords must only rent what they own. If they own a property with off-street parking for one car, two cars, three cars, that is the criteria they must use when acquiring their tenant.

Asam says he drives around. Does he drive around between 2 and 5am? Does he and his tag alongs have a clue how many cars a typical (white, born in the USA -- does that make you guys feel better now?) family have these days? If both parents have to work to make ends meet then they need two cars. If they have kids old enough to have cars then there will be one each for each kid -- this is California, land of the car, think about it Asam. So it will not be uncommon for any and every household to have three or more cars. And in most cases one of those will be on the street. Woe to the one who gets home from that second job or that night class and has to park on the street. Asam and his thugs Ed and Marie (and you too Dicky) may have towed it away. It's a good thing this attitude didn't prevail 20 or 30 years ago Asam because you wouldn't be here now yourself. And Marie, it won't be an issue to be able to park near my house because you're going to make it illegal to do so anyway. Your entire logic is flawed.

It looks like our city council is doing what CITIZENS/VOTERS want. The mayor is in her own world (Hippie 60's) Its about time we had a local goverment that isn't intimidated by non-citizen that rape our system. Our infrastructure was not meant to handle the influx of non-skilled laborers, ... and traffic that illegal immigrants bring with them. Get a clue, and stop using the "race" card as your sole defense. "Racism" is the first arguement for a debate when you've realized your opinion is WRONG.

More study IS needed wrote on Mar 29, 2007 10:16 AM:"Mr" Abed thinks that no more study is needed because he's driven the streets. The fact is, not every street in this town is impacted by multiple vehicles per household. The city should do a comprehensive study of parking on every street and determine if it is at or near its capacity. I may not like lots of cars parked on my street, but there is actually plenty of space for cars to park and thus my neighborhood should NOT be forced to deal with this ordinance. Vigorous housing code enforcement is the answer, not more laws shot from the hip of a possibly well-meaning but completely ill-informed and fiercely political city council. And frankly, though I like her style, the mayor does need to step up and lead on this issue. She has yet to propose any meaningful alternatives to the proposals of her colleagues.

2 Car Driveway 3 Car Family wrote on Mar 29, 2007 10:31 AM:I support the point they're trying to make and the spirit of what they want to accomplish, but I own a 3 bedroom home that houses me, my husband and our 2 teenagers. My husband & I each have our own car and one of our kids just bought hers (the other one will be ready in a year). I know I don't own the street in front of my house, but something like this could really impact our completely legal & legitimate household.

Even most apartment complexes have at least 1 designated spot for the renter and extra spaces for the other car. It is against the law to block a sidewalk with a veichel. So I park my truck in front of my house. Since this is a rental, I guess that the city isn't going to mind if I start parking in the front yard. If reasonable housing growth AND commercial/light industry would have been encouraged by the current council and councils in the past this would not be an issue. There are too many slumlords and illegals in this city and they are both a major reason for all the problems. It's not so much the tenants fault as it is the slumlord. Maybe this will force these people to only rent to as many people as he has parking spaces for. We pay taxes, those of us that are legal, for a street sweeper and I'd like to see the street in front of my home get swept once in awhile. Not sure if they sold but in the last few months there have been at each house, no less than 15 cars parked, some on the lawn, 3 deep and side by side in the driveways in the driveways. They used to be nice houses.The curtains are all drawn, never see anybody. The lawn is overgrown. Its a 700-900k neighborhood. Word is some woman is buying up homes, charging 500 a month to 15-20 people. Thats 7500 a mnoth in rent income. No wonder she can afford to buy up these houses. I'm sure she doesn't live anywhere near here too. They are trashing up our once nice city. It has to stop and has to start somewhere. Start fining the hell out of them.

Just because the Escondido City Council wants to get at the immigrant population it will use an unfair law that will affect everyone. The City Council needs to have a short leash placed around the three stooges neck. They need to worry about the potholes and sidewalks for our schools first.

Also, the NCT agenda reeks in the POORLY written article: The council clearly stated that this is dealing with a health and safety issue - not illegal immigration. The impacts to neighborhood quality of life and the public infrastructure were discussed at length at the meeting. The WHOLE council supported hearing from the public and there are more public hearings to follow. Clearly the newspaper wants to incite folks against the council trying to clean up the city. Legitimate large families will NOT be targeted at all. That was made as clear as day at the meeting - but of course the NCT did not print that.

I think the city should enforce current statutes such as unregistered vehicles on public roadways, illegally converted residences, boats, trailers and other larger vehicles on the roadway. As a resident, I believe if you feel as strong about this issue then the community needs to send a message. Don’t shop in Escondido. Take your tax dollars elsewhere. Economic impact can change the direction the city council members are choosing to go. If you have a specific issue to address (i.e., illegal immigration) then address that issue. Thinking outside the box shouldn’t punish everyone.

Another thing that really bothers me is the number of motorhomes and trailers parked in front of the house. Spend the money and store it. The police could at least start ticketing those people, which they have not been doing at all, and tow the huge eyesores

I want to live in a safe, beautiful, and inviting community. I think the City Council is trying to do that for all of us. Some people on here talk of racism. It is just sad that the bahavior on this site is such that you might hear this same kind of talk on the playground of an elementary school where kids there have been listening to their parents spewing hate messages and are repeating what they hear at home. People there are problems here that need to get addressed. Stop acting like bad kids and grow up. HELP solve the isuues facing this community instead of creating new problems.

Me, I have to park on the street as there is no driveway where I live. Are these people crazy? What the heck do they going to do with empty streets and cars parked in their yards? Yeah, that solves the problem. The real problem is SINGLE family homes having thre and more familes living there. Why not take care of that issue and the cars will be dispersed more evenly. And as far as this city council goes..if you really want to keep your jobs...get more information before you come up with some hair brained idea like this. And for those of you that agree with this council, obviously you have driveways and enough parking to park your two cars, SUV and boat on your own property. For those of us that DON'T have driveways and garages becaue we live in the old part of Escondido...WE HAVE TO PARK ON THE STREET!!
