No wonder police officers quit asking about immigration status! The Supreme Court threw out Mrs. Mena's case. No $60,000! No constitutional right to hide ones immigration status. The Supreme Court said, 'mere police questioning does not constitute a seizure. . .even when officers have no basis for suspecting a particular individual, they may generally ask questions of that individual; ask to examine the individual's identification; and request consent to search his or her luggage. . . Hence, the officers did not need reasonable suspicion to ask Mena for her name, date and place of birth, or immigration status.' So Carlsbad Police officers should ask for a person's immigration status and make a record of the response if the driver fails to produce a valid driver's license!
