Family of imprisoned agent speaks to Escondido church

ESCONDIDO ---- In the midst of an emotional, national tug-of-war over illegal immigration, it's a case that stirred controversy: Two U.S. Border Patrol agents shoot a suspected drug mule and land in federal prison, each sentenced to more than a decade for assault, obstruction of justice and civil rights violations.

The shooting happened hundreds of miles from North County, along a lonely stretch of border near El Paso, Texas, where the Rio Grande separates the United States from Mexico.

But the story found itself front and center in Escondido on Sunday, when the wife and father-in-law of one of the convicted agents shared the story of their struggles during a service at North County Baptist Church.

"It's just been a nightmare," Monica Ramos said as she stood in front of the congregation. "Two years ago, I never thought I'd be standing here, being my husband's voice."

Ramos' husband, Ignacio "Nacho" Ramos, was a senior agent with the Border Patrol for 10 years when the shooting occurred in February 2005.

Ramos and fellow agent Jose Alonso Compean were imprisoned earlier this year for shooting Osvaldo Aldrete Davila in the backside after he struggled with one of them and fled on foot toward Mexico. Davila made it back across the border to Mexico and sped off in a waiting car.

According to reports, said the agents were unaware that Davila had been hit by gunfire and did not initially inform superiors that shots had been fired.

Before the shooting, the agents and others were chasing Davila as he drove a van, which he ditched during the pursuit. It turned out that the van contained about 750 pounds of marijuana.

Later, at their trial, the agents testified that Davila had something shiny in his hand and pointed it at them. Davila, who was given immunity, testified that he had nothing of the sort.

The jury acquitted the agents of attempted murder, but convicted them on other charges.

Ramos and Compean went to prison in January to begin serving their sentences: 11 years for Ramos, 12 years for Compean.

The bulk of their sentences is the 10-year statutory sentence for using a firearm during a violent crime.

The agents' case has spurred passionate support and opposition as the nation finds itself in a heated debate over illegal immigration, especially in border areas from California to Texas.

Supporters of the agents say that the two men were law enforcement officers doing their job, that Davila was a drug runner and that the wrong man went free while the agents sit behind bars.

Opponents, including local immigrant rights activists, point out that Davila says he was unarmed and was shot as he ran away.

"What they did was absolutely wrong and they acted above the law," Enrique Morones, founder of faith-based groups Border Angels and Gente Unida said Friday. "They shot somebody in the back and tried to hide the evidence."

At the moment of the confrontation, Morones said, the two agents did not know that Davila was a drug mule.

"They found out later," he said. "They didn't know it when the made a spur of the moment decision."

In their quest to free the agents, Monica Ramos and her father, Joe Loya, have found themselves on the national media circuit and speaking at engagements from coast to coast.

Clint Miller is the pastor of North County Baptist Church ---- soon to be renamed Oasis Church ---- and the invitation to Ramos and Loya was his doing.

"I felt the call of the Lord to stand up and be on the front lines and be a part of it," Miller told the crowd. "I'm so deeply sorry for what these families are going through."

During the service, with red, white and blue banners, balloons and flags adorning the church, the congregation jumped to their feet to applaud the family of the convicted agent.

Miller, whose services are televised locally and nationally, encouraged people to visit Ramos' Web site, to send him letters in prison and to donate money to his cause.

Monica Ramos clutched a tissue, one she would use often on stage. Her father held an American flag.

"It's so hard for a grown man to find a place to cry," Loya told the congregation. "Sometimes, I have to hide."

Loya said the family has spent $250,000 in his son-in-law's defense so far.

Monica Ramos said the time in prison has been hard on her husband, who was moved to an isolated cell in a Mississippi federal prison after taking what his wife described as "a severe beating" at the hands of fellow inmates.

She said she and their sons live through the letters he sends. Phone privileges are minimal: 15 minutes a month. He is in a cell for 23 hours a day.

"A little bit of him dies every day," Monica Ramos said after the service.

She said the plan is to appeal her husband's case, and that she is losing hope for a presidential pardon.

As for the reaction she has gotten, it has been mostly wide support. There have been a few death threats, but the opposition from her standpoint has been minimal, she said.

Justice for all wrote on Apr 1, 2007 9:53 PM:My prayers for these families, and for all people's families of those dying on this border. since operation gate-keeper started 4000-10000 had died crossing the border. let's put a human face to everyone suffering on this immigration chaos. my prayers for thos children with-out parents because they were taken by I.C.E. last week, some of them will become horfans ,with their parents taken by the desert or the bullets of immigrant hunters.

Our federal government is paralyzed by ambivalence. If it does not soon overcome its inertia, there will be no American sovereignty left to defend.

Most of the public only gets the BS from grassfire and other highly biased groups. They shot at an unarmed man, lied about the shooting and actively participated in a coverup. They shot at a man who was running away from them, they were in no immediate danger, but they shot at him anyway, those facts are not in dispute by either party. Then, they "forget" to report the fact they discharged their firearms in the line of duty...definetly not the tyoe of people I want out there backing me up. I feel for their families because it cannot be easy on them. As for Justice, those children still have parents, they werent taken away to be slaughtered or anything like that. They were brought back to the country that they are legal citizens of, nothing is stopping those children from returning / going to Mexico to rejoin their parents. Oh yeah, in the English language, they are "orphans", the letter H has a sound associated with it.

They caught Davila crossing the border with drugs, so it is an absurd that Davila would have any credibility in testifying that he did not have a weapon, and as to the fact that Ramos and Compean did not know at the time that Davila had drugs, Davila was still committing a crime. It is unbelievable that Davila is free, and that Ramos and Compeon are doing Davila's time for him. Justice for all is for those who respect and abide by the laws of this nation. If anything, there are others who should have been prosecuted for the obvious coverup that took place, including the supervisors on the scene. Once again, the United States of America has thrown yet another welcome mat out for the criminal element of Mexican society. This criminal drug runner has received a full pardon, he will be bringing his family into the USA, we have payed for his medical care, and he has filed a multi-million dollar lawsuit against the Boarder Patrol. What kind of message does this send to criminals? The USA welcomes and rewards drug runners with a van full of pot. We will punish the officers that try to stop you, give you legal entry into our country along with your relatives, and after your lawsuit, you'll be living large... for being a criminal. How crazy is this!

The issues here are a lack of good judgement, integrity and honesty, not illegal imigration. This is about the unjustifiable use of deadly force, the agents' failure to confrom to their own agency's reporting policies about such, lying and then concealing evidence. Heroes-I think not. Doing what they were sworn to do-I think not. To think otherwise, is a slap in the face to the vast majority of honest, hard working agents that have a thankless job.

Hey I'm a conservative right and I am willing to admit that something is wrong here all the way to the White House, but the complete truth was not given in testimony and the fact that several jurors have even stated that if they had all the evidence (which has been proven to have been withheld) they would have made a different decision in their verdict. The agents shot because they belived him to have a weapon. More over the guy was running and wouldn't stop. An agent had already been injured in the pursuit. Afterwards, the agents attemped to file a report but that went missing. I've heard them say they did nothing wrong, and I believe them. Again, I can't believe how many antiAmerican people we have on this blog. Go find a utopian country where all your political correctness will come in to play. What they were sentenced for, was what a single witness against them testified to in court. The federal prosecuter hid evidence and they were railroaded. Where is the ACLU in this. Had this been the other way around, the liberal media and the ACLU would be screaming it coast to coast. The people deserve to get fired, not imprisoned. Just look at the trial transcripts.

But if you look into this case the 2 agents that are in jail, went around collecting all of their shells and hiding them, did not report that they fired their weapons, and did everything possible to cover up and lie about what happened. The drug runner should be in jail too, but these agents are an embarrassment to the Border Patrol and should serve their time.

If you run when an officer tells you to stop, you are probably dangerous even if you don't pull a weapon that everyone can see in clear sight. How many officers have to die before we give them the authority to make the life-and-death decisions in a split second and give them the benefit of the doubt even in cases where their judgement may not be the best? (which i don't think is the case here)...think that you can do better??? IT'S TIME we give the officers back their guns and sticks and let it be rule that if you run from them when stopped, well it's up to you if you want to risk your life. We might see a few more alive policemen and we just might see safer neighborhoods. That's my $.02.

The mistake these agents made was not shooting to kill. It's a harsh reality but this creep went back to his mother's house with a bullet in his butt and his sweet Mom, who doesn't care that he's smuggling and peddling dope called her friend whose son is a border agent and said, "Can they do this?" and the rest is history. If he was dead in a gully with his dope, all his drug peddling friends would have gtten the message that we're not screwing around here. And maybe his mother would have had to face the fact that her son is a ... drug dealer and these agents would be free instead of the target of some career prosecutor trying to make a name for himself.
