Escondido council divided over Hazleton ruling's effect

ESCONDIDO ---- Escondido City Council members were split Thursday over whether a federal judge's ruling striking down a hard-line anti-illegal immigration law in Hazleton, Pa., has quashed the possibility of reviving a similar law that was passed and then abandoned here last year.
The two cities are among dozens that have attempted to enact illegal immigration laws, sparking a national debate over whether local governments should tackle what many people say is a federal issue. Some municipal governments say that their cities are being adversely affected by an influx of illegal immigrants while the federal government fails to improve border security or reform the country's immigration laws.
Like the Hazleton law, Escondido's ordinance faced a legal challenge by the American Civil Liberties Union after the council passed it in October. The law, which would have punished landlords for renting to illegal immigrants, was abandoned after a judge temporarily blocked it and the city faced rising legal fees.
Since then, two of the three Escondido council members who had voted in favor of the rental ban, Marie Waldron and Sam Abed, have indicated they would like to bring the law back in some form after the outcome of the Hazleton case.
Abed and Waldron said Thursday that despite the ruling that Hazleton's law is unconstitutional, they haven't ruled out the idea of renewing the rental ban in Escondido.
Waldron noted that Hazleton's law, called the Immigration Relief Act, wouldn't have just punished landlords who rented to illegal immigrants, as the Escondido law would have done, but also would have revoked the business licenses of companies that employee illegal immigrants and would have made English the official language of city business.
"Hazleton did some things different than we did," Waldron said. "I'll be curious to see the comments the judge made on the rental ban specifically to see if we can learn from that and go forward with an improved ordinance."
But Mayor Lori Holt Pfeiler and Councilmen Dick Daniels and Ed Gallo all said that the Hazleton ruling has left little doubt about how another Escondido rental ban would fare.
"There's certainly no basis to bring forth an ordinance like that again," said Daniels, who was elected to the council after the Escondido rental ban was passed.
Pfeiler, who voted against the rental ban last year, said tackling the ordinance again would waste more money and would put local government in a role meant for the federal level.
"It still comes back to two issues," Pfeiler said. "We as Americans need to stop hiring illegals, and the federal government needs to step up and deal with the issue. When local cities try to solve the problem, we just spend taxpayer dollars that would be better spent on local services."
Gallo, who voted for Escondido's rental law last year, said that if Thursday's ruling had been favorable toward Hazleton, "I think we would have had some serious consideration" for renewing Escondido's law.
But now, he said, "I don't see that happening right away."
If Escondido were to go ahead with another rental ban and fight the inevitable legal battle, the liberal U.S. 9th Circuit Court of Appeals would be a difficult obstacle to overcome, Gallo said.
"Our chances there are slim to none," he said. "I think we have a tougher row to hoe than even Hazleton."
Complicating matters further, Gallo noted, is a bill introduced earlier this year in the California Assembly in response to Escondido's rental law.
Assembly Bill 976, brought by Assemblyman Charles Calderon, D-Whittier, would prohibit city and county governments from requiring a landlord to "compile, disclose, report, provide, or otherwise take any action regarding" the immigration status of a tenant or prospective tenant. The bill has passed the Assembly and is being considered on the Senate floor.
Council members said they weren't surprised by the Hazleton ruling and that they have found other ways to address the effects of illegal immigration without wading into murky legal waters.
The council is attempting to pass an overnight parking ordinance that would restrict parking on residential streets in an attempt to reduce overcrowding and improve the appearance of neighborhoods. Some council members blame the overcrowding in part on illegal immigrants.
The Escondido Police Department announced a new policy earlier this year of working more closely with Immigration and Customs Enforcement to detain suspected illegal immigrants who are cited for even minor crimes.
Council members also cited the city's Appearance and Compliance Team that conducts monthly sweeps looking for illegal garage conversions, fire code violations and other property offenses, as another of its efforts to improve the quality of life in Escondido.
"When you have a higher standard in our city, that will probably discourage illegal immigrants from coming to our city," Abed said.

Glad to see Mayor Pfiler is finally for getting employers to stop hiring them! Now that everyone has admitted there is a problem, you and we can go about fixing it. Having ICE in the city jail is HUGE! Checkpoints are very effective. Tough law enforecement goes a long way. Shows a lot of irresponsibility and political immaturity by some of our so-called leaders. It will be a great day when Waldron, Gallo and Waldron are unseated. There is more than one way to skin a cat. We knew that at this late stage, that addressing this issue wouldn't be easy. My advice to the City Council as an active legal citizen and taxpayer, is to become more involved in our code enforcement department. I don't want to point fingers but you really might want to pay more attention. Just a word to the wise...code enforcement issues need to be addressed equally across the board. If you want our support, you need to be honest. People talk and experiences are shared. Don't say I didn't warn you.

Becoming involved in aiding and abetting is a felony! They may need to try my two-step plan. We may have to kiss the keisters of the illegal invaders, it is still a felony to aid and abet them. Not Over Yet wrote on Jul 27, 2007 6:28 AM:What this article neglected to say is that the case is on appeal to a higher court and will go all the way to the Supreme Court for final ruling. It was common knowlegde that the judge hearing the case was liberal and it was expected that he would uohold the interests of non citizens over citizens and taxpayers who fund the services illegals use. I just pray we are not stupid enough to elect Clinton or Obama for President as they clearly support Amnesty and more of the same.

We do see that the pro-illegal alien side of the Escondido Council, Mayor Lori Holt Pfeiler and Councilmen Dick Daniels was happy. Ms. Pfeiler evidently doesn't see the gang violence in Escondido, mainly committed by illegals, as a problem. She also doesn't see poorly performing schools, which have been decimated by illegals, or graffiti as a problem. Evidentially those are somehow federal or employer problems. She is happy to spent $1 million a year on graffiti removal and sees no tie between graffiti and illegal immigrants. No wonder we see the problems we do in Escondido.

James wrote on Jul 27, 2007 7:01 AM: All Hazleton has to do is appeal to the Circuit Court and then to the Supreme Court. This is certainly an issue the Supreme Court needs to decide. It is a conservative court and perhaps with render a balanced decision. Escondido would also need to go to the Supreme Court for relief because the 9th Cir. is considered very liberal. This certainly is not a victory for the ACLU because if Hazleton appeals it is only the BEGINNING of litigation.

'No State shall, without the consent of Congress, . . . engage in War, unless actually invaded . . . .' US Constitution, Article I, Section 10. Hazleton and Pennsylvania have been 'actually invaded'! If Hazleton makes a factual finding that it has been invaded, then the Hazleton Police Department can detain and deport all illegal aliens within its jurisdiction, and the Federal Government is violating the constitution if it uses any force to stop such constitutionally sanctioned actions.

Americans want it, and only the courts and a lame Congress are preventing the ban. Renting property is a business. The business relationship between landlord and tenant is a long term relationship lasting for months or years. Asking a landlord to spend a few minutes to verify residency status using something like an I-9 form, much like employers are now required to do, is not a big deal except to the illegal immigrant who is trying to blend into the existing community undetected. In the next election, voters must demand that candidates take a stand on the rental ban issue. Illegal immigration is the biggest issue now facing our community, and our elected officials must be held accountable for not pursuing the very effective remedy of a Federal ban on renting to illegal aliens.

I am proud that escondido is fighting back with all the checkpoints and other things they are trying to do. All we want is a nice clean city to live in. If these people didn't commit crimes or spray graffiti I really wouldn't care if they were here. For some reason..education to them is not a high priority. Thankfully, my kids go to the best elementary school in Escondido and we don't have any problems with kids that can't speak english. I feel for those hard working American parents that have to put up with this.

The American taxpayer is tired of paying the bills for illegals who receive free health care, free education, free money every month for babies while paying no taxes and sending billions of dollars back to support the economy in their native country. At least some in local government see the disgust of their constituents and are trying to pass laws that support the federal laws already in existence. Why if it is illegal to just sneak into the country isn't it a crime to rent to a person in the country illegally? Why aren't employers who hire them being arrested and severely fined? Why did we allow it to get to the point where there are millions of illegal people living in the country violating our tax laws every day? Somehow the federal government thinks we need an exploited slave labor class for corporations to reward their CEOs and stockholders. Oh, it is not the illegal immigrant who is the exploited class, it is the working poor who can't earn a living or get free health, education and social services making minimum wage!

While we are having these heated debates on illegal immigration and its consequences, the laws, you remember the laws, are right on the law books in black and white. Any citizen can go and look at them. That is why they are written down. What you will find is this, Illegal immigration is a crime, those aiding and abetting it are breaking the law. The consequences and penalties are spelled out. How much an employer must be fined, that it's a felony to come across the border X number of times,and so on. What should really concern Americans who accept and live under the laws is that none of this is being enforced. Do people realize how serious it is when an administration simply decides what law it will or will not follow? That is what happens in dictatorships. We are in serious trouble.

It was like that more than 20 years ago but slowly got better. Now with the likes of these founding father quoting minutemen types we've gone back more than 20 years as far as race relations. These people are not speaking for me and the country I'd like to live in. The founding fathers had a lot of hypocrisies as far as race relations, so quoting them doesn't serve any purpose in this problem. The city council is just spreading division and accomplishing nothing but media attention, and for what? Escondido should just succeed from the union. There's no place in this country for racist hatred even on La Raza too. Open borders are the way to go. It was that way for a long time and worked just fine.

This is a Federal issue, and has to be dealt with there. Angry? Ticked off? Start writing letters to Bilbray, Boxer, Feinstein, Issa, any and all of 'em. Write letters to the candidates for Prez - its too late for Bush to do anything, and besides he wasn't seriously looking at the problem anyway. But lauding these two thick skulled councilpeople for persisting in their belief that they can disregard the Federal law and the Consttitution is a waste of time, effort, and money that the City doesn't have.

However, in light of hearing the hateful rhetoric used by many such individuals, I believe there is something more to this movement that can only be described as prejudice. Once the dehumanizing speech stops, perhaps we can work out this issue like civil people.

If the Federal Government did its job this wouldn't even be an issue. Citizens are also seeing through the bashing Bilbray letters. Bilbray has been doing more in congress than many of the Reps. before him. I don't know how much Bilbray is sitting in his office in California but I do know he is working for a better California. I would hate to think what it would have been like to have had amnesty Busby in office. Bilbray is a fighter and doing a good job for us. Thank you Congressman Bilbray!!!

Today when I went outside I noticed two trucks with U-hauls and a new family moving in next door. Now it appears that the original family of five and a new family of 7 is living next door to me. The new family does not speak English, and both of the adult females are pregnant. Today there is 6 cars parked next door, and I hope this is it for awhile. These people are not poor as they have nice cars and property, but if they are like the last ones, they will be here for awhile. It does not matter that our houses are worth over half a million dollars, as I now have at least 12 people living in the single family house next to mine.
