Suspected drunk driver drives away from crash with dead motorcyclist in rear window

PERRIS, Calif. -- A suspected drunken driver crashed with a motorcycle and then left the scene, unknowingly driving away with the motorcyclist's dead body lodged in the rear window of his car, investigators said.
Tony Martinez, 54, pulled out of a parking lot Saturday night and cut off motorcyclist Nicholas Justin Campbell, who was traveling about 80 mph, California Highway Patrol spokesman Ron Thatcher said.
The motorcyle crashed into the car and Campbell was thrown through the rear window, Thatcher said. Martinez then drove away and realized when he got home that the motorcyclist was in his car, Thatcher said.
Martinez then drove to a Riverside County fire station where 20-year-old Campbell was declared dead, according to the coroner's office.
Martinez was arrested and booked for investigation of gross vehicular manslaughter, hit-and-run and driving under the influence. Bail was set at $75,000.

Modern wrote on Aug 29, 2007 2:56 PM:Sad to see him die like this. However, he was driving 80mph and this was not even the freeway. Much of the blame should go to the Motorcycle driver. No reason to drive that fast in the street. All he did was pull out of a parking lot. This could of happened to anyone pulling out of a parking lot. And no checkpoint would of prevented this. So don't go blaming the lack of checkpoints on the death of this poor guy. They are both at fault here.
My Take wrote on Aug 29, 2007 4:28 PM:I believe Oz was referring to the complainers who crawl out from underneath their rocks everytime a DUI checkpoint is advertised. They don't support check points, arguing that they infringe on their right to drink and drive. They help reduce, but will never completely prevent, tragedies like this one because of people described above. There's no question that doing 80 at night on this road was extremely poor judgement.
Modern wrote on Aug 29, 2007 8:17 PM:Defending our 4th amendment right is hardly complaining. The 4th Amendment guarantees freedom from search and seizure without probable cause. There is no probable cause for the police to routinely stop you at a roadblock to look for criminal activity; whether it be drugs, weapons or terrorists. But I digress, this is not the forum for DUI discussion. 2 lives were lost because of poor Judgment.

esteban wrote on Aug 30, 2007 6:15 PM:Hey Modern....the 4th Amendment protects us from UNREASONABLE searches and seizures. Stopping for two minutes at a checkpoint you chose to drive thru is hardly unreasonable. Don't know much do ya?
doug wrote on Aug 30, 2007 6:16 PM:Can someone tell me what critera the CHP uses to determine that the bike was traveling at approximately 80 mph? Is the hole a human makes in the rear window of a car a different size when traveling 60 mph? Anyway, its an accident, its a shame. RIP

paul wrote on Aug 31, 2007 4:27 PM:Doug, the speedometer will be stuck at the speed the vehicle was going at impact. This same method of investigation is used in aviation incidents. This won't work with a totally electonic system, but if the bike had a analog or semi-analog instrument it would show the speed at impact.

A drunk driver is a drunk driver. And a driver without a driver's license is twice as likely to be involved in a fatal accident.
