Bush administration urges court to open borders to Mexican cargo

SAN FRANCISCO -- The Bush administration urged a federal appeals court Thursday to let Mexican cargo trucks cross the border and freely travel anywhere in the country, arguing that to do otherwise could strain diplomatic relations between the U.S. and Mexico.

The Teamsters Union on Wednesday asked the 9th U.S. Circuit Court of Appeals to stop the program, which the administration said would go into effect on Sept. 6. The plan would let as many as 100 registered Mexican truck carriers drive their cargo anywhere in the country for the next year as part of a "demonstration project."

The court gave no indication Thursday afternoon when it would rule.

The union, along with the Sierra Club and the nonprofit Public Citizen, argues that the administration plan would endanger public highways because safety issues have not been resolved.

But in its filing Thursday, government lawyers said the trucks enrolled in the program meet U.S. trucking regulations and the program is a necessary part of the North American Free Trade Agreement.

"Participating Mexican carriers must comply with all legal requirements governing operations of domestically owned carriers, and in some cases stricter requirements," wrote Assistant Attorney General Peter Keisler.

NAFTA requires all roads in the United States, Mexico and Canada to be opened to carriers from all the three countries. Canadian trucking firms have full access to U.S. roads while Mexican trucks can only travel about 20 miles inside the country at certain border crossings like in San Diego and El Paso, Texas. The government's filing said some 4.5 million of those short trips across the U.S.-Mexico border are made each year.

"With respect to those operations, Mexican carriers are maintaining a regulatory compliance record that meets or exceeds that of United States carriers," the government said in its Thursday filing.

In its papers, the government also said "the critical bilateral relationship between the United States and Mexico would be placed under considerable strain by further delay in the demonstration project, which is an important interim step toward fulfilling U.S. obligations under NAFTA."

In court papers filed Thursday, the Teamsters said the U.S. and Mexico have been wrangling over this issue for at least seven years.

The Bush administration "can not seriously contend that a few months delay now to make sure that the pilot program is implemented in conformity with and not in violation of the laws of the United States is going to be critical after all the past delays," Jonathan Weissglass wrote for the union.

Letting Mexican trucks travel throughout the U.S. would be a financial boon to Mexican carriers who have to now transfer their loads at the border. The government also argues that U.S. consumers will benefit because it will be less expensive to ship Mexican goods if Mexican carriers are given access to the entire country.

Earlier this year, Congress ordered the Department of Transportation to launch a pilot program to study whether opening the U.S.-Mexico border to all trucks could be done safely.

The Teamsters and Sierra Club argued in their court papers the program proposed by the administration won't yield statistically valid results and the public wasn't given ample opportunity to comment.

"This is just more deceit from the Bush administration," said Teamsters President Jim Hoffa, who said he was skeptical of administration claims that Mexican truck drivers will be tested for drug and alcohol use.

"How can that be when there are no drug testing labs in Mexico?" Hoffa asked.

John Hill, head of the DOT agency charged with managing the program, said the testing will be done by U.S. companies.

"We believe the established safety protocols are quite rigorous," said Hill, who is head of the Federal Motor Carrier Safety Administration.

Also, the union complained American truckers should be given similar access to Mexico, but the U.S. government said it's "beyond question that Mexico has committed to provide reciprocal authority to U.S. carriers."

The union countered in court papers filed late Thursday that the government has provided no details of the reciprocal agreement.

There was a bill passed in the House to stop this pilot program which bill was never addressed with a Senate version. What the Senate did was attach something to the back of a spending bill allowing the implementation of the program. When you call the Senators about answering the House bill they say it's no use as it's a done deal.

This would allow anywhere from 1200-2000 trucks in. The government can keep a running tab of how many trucks can enter on a daily basis like controlling the number of cars allowed into a parking lot with limited parking spaces, 10,000 illegals out = 1 truck in. Sounds like a win-win to me!!!!!

They have to sleep in the truck and when they have a delivery in New York they can not sleep because of fear of robbery or hijacking of the cargo. They would not have a chance down in Mexico- there are thousands of murders and kidnappings, it would be too dangerous for them in Mexico and they do not speak spanish. He states that President Bush has had 400 vacation days since being elected. Also he has been at his Kennebunkport home 465 times. Must be 65 times were actually business related. Kudos to Dobbs for pointing out that it's actually better for Bush to be at his vacation home, because it's too scary for us for him to be in the White House. I say Amen to that.

This is not a question of prejustice. This is a matter of fact. The fact is that mexican drivers have no idea about our highways and I am sure most if not all of them haven't got any idea how to speak english, never mind read it. Are they all going to tested for this before they cross and as far as the drugs they are on, someone mentioned they would be teseted over here...well at who's cost, Ours or theres... this is not about anything other then someone got paid off to make it easier for illegals to get into OUR country. Bush is opening our roads to people that dont know how to use them safly and there will be deaths because of it... I see that some are saying it is not all Bush that Clinton started it all with NAFTA but we must look at it in this perspective. If we blame Clinton for this then we need to go back to the begining of our fine country... just because Clinton sign'd on the dotted line for NAFTA doesnt mean it is his fault that Bush has found another way to use something to his advantage and is using it for his own profit.... as far as impeachment goes.... HEll Ya , how much worse can the vice president be... and if he is no good we do it again.. and again and again... WE ARE THE PEOPLE AND WE NEED TO BE HEARD... Truely it is our fault that all this is happening. We have let so much go on for so many years that we as US citizens have lost control of what we went to war for so many years ago... our own freedom. It is now time to stand up for ourselves and make ourselves heard... I am not saying go to war or anything but we created and built the system that is now hurting us more then helping us...so it is time to unplug it and reboot it. It has a virus and that virus is the Bush administration... Time to break out the Anti-virus and purge our country of what is doing damage to it... This is so much more then just truckers from mexico it goes so much deeper then that. How could we not expect something like this? I mean serious! How stupid are we? We allow allians to come to our country and we feed them and clothe them give them jobs and support them and thier families and what do they do take our money and send it back to thier families everywhere else. I lived in california for some time and went to mexico a couple times and they stopped us and checked our car for fruit and such.... why? If we are just going to let them bring anything they want into our country then why? Think about how many trucks will get threw to us with hundreds of illegals in them where they are not being inspected and such we might as well take down the borders and let them all in...There is no issues with the people that come here and get a green card and pay taxes and such, they are doing what is asked of them. It is the fact that we have such a problem with those that don't follow our rules and laws... Now we have just givin them a way in without fear. The mexican government has no issues with this. They in more ways then not support the illegals comming here and taking our money and jobs and sending it back.... Mexico is a third world by choice, they choose to be this way. They have the means and resources to be otherwise but choose not to be anything but a corrupt ceespool of drugs and control.... Let them deal with what they have created not us...As a citizen of the united states I believe we have a system of government that will work if used correctly.It is up to us to say enough is enough, we need to stand together and focus on our own country and our government and make some serious changes... Then the high tech industry bribed our government via political contributions to allow the importation of "skilled workers" that are replacing "American skilled workers". An education in a professional field doesn't exempt you from being "replaced" by an import willing to work for half the salary. The American people have the power to put a stop to this but all I hear is lip service with very little action. We have the best government money can buy!
