Police: Man killed after battling officers

OCEANSIDE ---- A 29-year-old parolee fatally shot by officers Saturday night wrestled with them and threatened to use a gun on the officers before they fired at him, police said Sunday.

Oceanside resident Siaki Ramon Del Rio died after police said he led officers on a brief car chase that ended when he crashed and struggled with three officers.

Sgt. Leonard Mata said Del Rio carried a loaded handgun at the time of the shooting that was later found in his clothes; Mata could not say Sunday night who found the gun. A passenger in the vehicle with Del Rio was not hurt, he said.

Court records show that Del Rio was involved in from four to eight prior criminal cases from 1996-2001; details were unavailable Sunday.

The pursuit began on Big Bend Way at about 6:29 p.m., after the officers attempted to stop a man, later identified as Del Rio, who they recognized as being wanted for a felony warrant, the sergeant said.

Del Rio, who Mata said was considered armed and dangerous, allegedly took off. Mata said a chase ensued for about four minutes and ended less than two miles away, when the suspect crashed into a shed and chain-link fence at a mobile home park in the 200 block of North El Camino Real.

Del Rio refused to comply with officers' orders and resisted "violently" when they wrestled with him in an attempt to take him into custody near the vehicle, Mata said. In a news release, Mata said that Del Rio told the officers he had a gun and threatened to use it "as they struggled to gain control of him."

Each of the officers fired their weapons; Del Rio was pronounced dead at the scene, the sergeant said.

One officer injured his shoulder during the confrontation, but he did not need to be hospitalized, Mata said. The other two officers were not hurt.

Police would not release the officers' names Sunday. They are on regularly scheduled days off and have not returned to duty, he said.

Del Rio's passenger was questioned and released, Mata said.

Several residents who live near where the shooting took place recalled police activity the night before. The area ---- which is just north of Mission Avenue and is made up largely of mobile home communities for seniors and apartment complexes ---- was quiet Sunday afternoon.

"Oh, I heard it. ... It was loud," George Chapman said of the gunfire and commotion. "I knew there was a chase. I knew something happened."

Chapman said he heard from six to eight shots, some coming in rapid fire, and at first thought it was rival gunmen shooting at each other.

The shooting was the latest of several violent incidents reported in the area. According to police, a man was stabbed in the face on Fredricks Avenue in May after allegedly attempting to sexually assault a female acquaintance. A month earlier, a drive-by shooting in the same location left three people injured, while a shooting in March at Fireside Park left another man injured.

Del Rio is survived by his wife, Diana, an investigator for the county medical examiner's office said. Efforts to contact Del Rio's family were unsuccessful Sunday.

This is not the movies and it is not TV. It is the real world and OPD has to put up with this kind of stuff far to often. He had a warrant but looks to me like he never even showed his weapon just said he had one. Maybe a stun gun would have been better in this situation. Yeah sure someone didn't need to die, but I personally would rather the bad guy die than my husband. I know that OPD officers work extremely hard and are good at what they do. Oh, and you should all stop watching and comparing the life of a cop to what you see on TV. Little do you know wrote on Dec 23, 2007 8:33 PM:This all took place in a neighborhood where the suspect was going up and down neighborhood streets at a high rate of speed trying to elude the police. He drove past homes and traffic at 6:30 pm he could have killed an innocent bystander all because he didn't adhear to the intial police lights and sirens. He was on parole, he had a gun, he did not want to be taken back to prison. I'm sorry it turned out the way it did, but OPD was doing their job to protect this city! It's very unfortunate it ended the way it did, IF only he would have pulled over to begin with. My condolences to his wife and children especially during this time of year. In fact, it states CLEARLY that the gun was LATER found on the suspect by an unknown officer. So where does it beacome was NECESSARY SHOOTING??? I understand necessary force, but not shooting the guy. He may have had convictions and an ugly past, but he didn't pull a gun out on them...

I could see if the guy killed someone or if he was trying to shoot at the cops but he didn't. My heart goes out to the family. Oh I guess we will never know who found the gun? Was it loaded when it was found? Was Del Rio wearing the clothes where the gun was found, or was the gun in his car with the clothes? Too many unanswered questions for me to make a decision on this matter. It would probably do all of you some good to go finish your Christmas shopping and wait for all the facts to be released, hopefully that will happen then start the trial of the dead Siaki Ramon Del Rio. Oh sorry about that I guess the trial is over and he was found guilty and sentenced to death. ... Lets wait and see what happens probably the usual stuff but hopefully one day justice will be served even if one has a criminal record we still have our Constitutional rights!!!!!

It was right for OPD to defend themselves but it was wrong to kill the guy. There were 3 officers against 1 parolee. No I?m not on this guys side, but people panic when they know they are in the wrong, we are human and we make mistakes, and a lot of them. The OPD officers may have did their job right all the way up to shooting, but don?t start putting the suspect criminal background up like that was suppose to justify and build a picture he was violent and dangerous, that makes it sound like your trying to cover something up. The story said he wrestled with officers, so you mean to tell me through the whole wrestling scene they didn?t find a gun at that time and all he said I have one and he was going to use it? So the OPD officers felt that as a threat ...? Just something to think about

He was threatened and so were the other Officers involved. This guy committed SUICIDE-BY-COP. I agree that NCT edits what they want. It only makes this more news-worthy. And by an amazing coincidence it's being posted by people who weren't there and/or have never been in a situation like this. What OPD SHOULD'VE done is use the degree of force necessary to overcome the threat. From the limited details that we have, there's no indication that they did anything other than that.

If he was on probation there is no way "IN HELL" he should have had a gun in the first place, which makes it a felony to carry it. The police did what they were suppost to do. "Protect". I dont know about everybody else, but if and officer tell me to stop... I would! But if I had a police dog or two biting me I would do what ever they asked. This guy threatening to kill the officer's hits to close to home for us in public safety in the city especially since the memorial of our fallen brother was just two days before. So don't be so quick to judge. Good Job brothers! You did what you had to. I sure feel alot safer.

You do not see him as he really was, the cops used all their resources to try and take him in without having to shoot him. HE AND ONLY HE made his choice not to go back to jail, therby getting shot. I think your kids will grow up in a safer environment without their dad around. Someday you might see real picture.

I know that we are taught to use batons ie nighsticks we are taught very well in the academy we are also taught self defense techiques and chokeholds, with three other officers I believe we could have handled the situation a little differently. Many times I have apprehended suspects single handedly who after handcuffing and searching retrieved guns, knives, and other weapons, they are all in custody and I am still serving my community. Sometimes it is just easier to shoot, sometimes we really dont care, sometimes were just tired of it all and sometimes people die, both suspects and officers, Im sorry for those sometimes, and I can talk because I walk a mile in my brothers shoes every day.
