Just the facts on SB 777

Forget everything you learned in kindergarten about the difference between boys and girls. According to Gov. Schwarzenegger and the California Legislature, schoolchildren can now choose their own sex. I'm not talking about choosing "sexual behavior or sexual preferences." Kids are going to be taught that they have the right to completely ignore their physical anatomy and choose the status of being "male" or "female."
Ignore your common sense, ignore your chromosomes and ignore your anatomy. This is what your politicians want to teach your kids in school. After all, California's kids have mastered reading, writing and arithmetic, haven't they? In October, California Senate Bill 777 was signed into law. Senate Bill 777 eliminates Education Code 212, which currently defines "sex" as "the biological condition or quality of being a male or female human being." And worse yet, SB 777 redefines the term "gender" for all schoolchildren by adding Education Code 210.7, which will read: "'Gender' means sex, and includes a person's gender identity and gender related appearance and behavior whether or not stereotypically associated with the person's assigned sex at birth." In short, this redefinition of gender states that you are what you choose to be regardless of your anatomical make-up.
SB 777 also uses this redefinition of gender to forbid educators from discriminating against any individual employee, student or other person based upon that individual's unspoken claim of being male or female, regardless of his or her actual sex.
Advocates for Faith and Freedom, a nonprofit law firm dedicated to pro-family issues, filed a lawsuit in the Federal District Court, San Diego, on behalf of the California Education Committee LLC, a project of California Family Council. Members of the California Education Committee include school board trustees, educators, parents and students.
The lawsuit argues that the redefinition of gender should be declared unconstitutionally vague as no school administrator or teacher would ever know whether they are unlawfully discriminating against a person based on their chosen sex. For example, how is it possible for an educator to segregate the boys from the girls if each individual has the ability to randomly self-define their sex regardless of their anatomy? Should educators really have to face the possibility of being sued for discrimination every time they segregate boys and girls or should they just be responsible for asking every child what sex they choose to be that day?
The lawsuit also argues that SB 777 is vague because Education Code section 51500 prohibits any teacher or school district from giving instruction or sponsoring any activity that promotes a discriminatory bias against persons based upon their gender or sexual orientation. Is a "discriminatory bias" being promoted when a high school chooses a homecoming king and queen or when a teacher discusses the role of a mother and father after reading a classic English novel?
Education Code section 220 prohibits discrimination based upon a person's self-defined gender in "any program or activity conducted by an educational institution." And Education Code section 200 requires "equal rights and opportunities in the educational institutions of the state."
If the school must treat a biological male as a self-defined "female" in "any program or activity" and in the "educational institutions of the state," does this require schools to allow the self-defined "female" to access female facilities? If persons can legally self-define their sex, shouldn't they be entitled to be treated that way regarding access to all public facilities? Sound outlandish? Not really.
The Los Angeles Unified School District has already adopted policies allowing boys to use girls' restrooms and locker rooms ---- and vice versa! You can read LAUSD's Reference Guide 1557 on the district's Web site.
It even tells teachers they need to refer to students using the student's preferred pronoun. And of course, it prohibits the teachers from disclosing a student's chosen gender to the student's parents. Since LAUSD has such a strong academic record, don't you think all school districts should duplicate this program?
Our schools should not be used as incubators for social experiments and our kids should not have to be subjected to the radical agenda of Sacramento politicians. It's time for our schools to get back to the basics and fend off these ridiculous efforts to brainwash our kids.

It only says, "at the discretion of an administrator," a student may be provided access to a restroom that corresponds to the gender identity the student has consistently asserted at school, and if more privacy is requested, the student would be provided a facility in the nurse's office or some other individual, or "unisex" restroom. Tyler implies all students could demand access to any restroom they choose by whimsically declaring a gender for the day. WRONG! And also more evidence of how he tries to cloud the issue with ridiculous claims.

At the end of the day, Ms. Kuehl only seeks to promote tolerance, civility, and space for children who feel different from their peers. Nothing wrong with that. At the same time, however, Mr. Tyler raises a valid point about innocently "heterosexual" school traditions (like having a homecoming king and queen) and how lawsuit-fearing school administrators will react (or overreact?) to the new legislation by stamping out these age-old institutional traditions in the name of "respect."

It's a long process whereby medical professionals trained in gender issues make sure that someone who claims to be transgendered is not transitioning for the wrong reasons. Most transgender knew they were this way from an early age (I know I did). I had an abusive stepfather 'beat the gay out of me', and in school I was a bully-magnet, enduring far more torment than those students who were 'normal'. It didn't prevent my transition, only delayed it. I have not married nor produced children because I knew it was wrong for me to do so. To the opponents of SB 777 -- you can't stop homosexual, you can't stop transsexual, you can only attempt to make sure your torture and torment of those afflicted by it is not criminalized, so you can continue to your prejudice, your bigotry and your hate with impunity.

That's the problem with a modern democracy: no one group gets to call all the shots, and making an effort to get along with one's neighbors is a civil obligation, even if those neighbors are very different.

Research has shown that there are indeed people who have brain structures which are typical of members of the opposite sex- biological men with female brains and vice versa. Quite frankly, as a transman, I would not wish the problems my GID has caused me on anyone. I spent years hating myself- I hated myself for being different than the other girls, I hated myself for wanting something that the moral authorities in my life said was wrong, I hated my body because it had the wrong parts.
I suffered, in part, because of people who felt that the line between male and female was so absolute that only perverts and freaks would ever try to cross it. It's sad to see that the so-called "moral authority" would punish children for being born with atypical brain structures. Thank you, Mr. Tyler, for showing that this mindset is still very much alive and well.

Opponents of civil rights for all Americans have always claimed that the people they don't like are inferior or damaged in some way. They make false claims about black people, native Americans, asians, gay people, hispanics - it's a very old story.
That's why laws like SB 777 are needed - to counteract the efforts of those who sow lies and animosity to support their prejudices.

The Dark Ages were brought about in Europe only AFTER Christianized rulers began suppressing same-sex behavior among ordinary citizens.
Anti-gay attitudes and behavior are a dangerous cause of social decay, and SB 777 tries to protect us against the
moral corrosion of bigotry.

If someone is indeed transgendered, they could learn to homeschool, or take physical education at a local exersise club instead of the public school. Home schooling is good for both traditional and non traditional students.
I know the gender issue is getting all the SB777 proponents up in arms, but Shelia should of just patched it up and said, mental gender based on doctor and or psychologist determination. So straight boys would not have the itchin of wanting to check out the girls in their changing rooms.
And honestly if you do not want these silly bills passed, get social conservative democrats who are socialists and then you can stop this legislation. Problem is no one wants Republicans gay or straight representing them in California. As long as the Democrat passes a 12.00/hr mininum wage bill and socialised medicine thats all the voters want it seems.

Find two friends or family members to join you and spread the word. In this particular environment, how will the California educators decide which Muslim girls will be allowed to wear burqua's, and how should a Muslim's faith be honored ? One of the Gov's broken promises was to audit the school system. The students are inundated each day with indoctrination of every new liberal agenda. The schools should teach knowledge and skills for students to grow into responsible adults and not have opinions indoctrinated into them. When the school administrators find that there is no end to how many separate restrooms they must construct, or build many "single use" facilities they might just back down.
They would also have to renovate (to smaller restroom cubicles) or abandon the current restroom facilities.

All this law does is allow students to legally identify themselves as members of the LGBTQ community and it also allows them to identify their gender. My father is a priest and I am a bisexual female. All my life I hear conflicting theories about who I am suppose to be. That in itself is the problem this law attempts to correct. The same way blacks were separated from whites and interacial dating was not allowed, homosexuals should not be separated from heterosexuals. For those of you who will take your children out of public schools, I want you to know that your child may still be gay or gender nonconforming - your child may simply be more depressed and suicidal than those children who have a support system in place for them.
Just because your children learn how to treat each other fairly and equally does not mean they will turn gay or become trans. You are so afraid of raising a child who is not "normal" why can't you just be happy that your child will be loved and accepted regardless of what others think? Is it so bad that my friends come from all different types of racial, ethinic, religious, cultural, and sexual bckgrounds? Is it so bad that I can have a conversation with a flamboyant male friend? Am I really a sinner for treating all my classmates like human-beings?
Furthermore, this has nothing to do with "indoctrination" of heterosexual students. No one can be turned gay or straight, and there is no such thing as an ex-gay person. If I decide to settle down some day with another female and we decide to have kids we could always ask our homosexual male friends for sperm donations. There are many children out there who have no parents who need love and financial stability - we could give it to them. What would you say about people who are infertile, are they going to burn in hell too?
Furthermore, being gay is not a disease nor is it abnormal. What is abnormal and unnatural is the inability to love.
Stop judging people - you are not God. Stop teaching your children how to hate each other. Don't forget the golden rule, "Do onto others as you would have them do onto you."
