Immigration rule on background checks eases

A change in immigration rules will allow thousands of immigrants, already in the United States and applying for legal residency, to get their green cards before FBI background checks are completed, officials said Friday.

Critics said the change could allow criminals to get through and threaten national security.

The change, which affects only legal immigrants already in the country waiting to adjust their status to legal resident, was outlined in a memo dated Feb. 4 written by Michael Aytes, associate director for domestic operations with the Citizenship and Immigration Services.

"In the unlikely event that the FBI name checks reveal actionable information after the immigration judge grants an alien permanent residency status, (the Department of Homeland Security) may detain and initiate removal proceedings against the permanent resident," according to the memo.

One of the reasons for the decision, immigrant rights advocates say, is that the U.S. Citizenship and Immigration Services, the agency responsible for deciding residency applications, is dealing with backlogs that mean years-long waits for some residency applicants.

The change would grant applicants their legal residency, or green cards, if they have been waiting on the back ground checks more than six months.

That worried Rep. Brian Bilbray, R-Solana Beach, who said completing the background checks is a matter of national security. Bilbray is chairman of the Immigration Reform Caucus, which generally favors stricter immigration controls.

"What we're dealing with is not just an inconvenience," Bilbray said in a phone interview from Washington. "It's an exposure to someone that shouldn't be in the country."

A leading critic of the backlogs has been the U.S. Citizenship and Immigration Services agency's own ombudsman, Prakash Khatri. In a 2007 report, Khatri called the backlogs one of the most "pervasive and serious problems" in the immigration system.

The report said the agency was waiting for FBI name-check results in about 146,000 cases that had been otherwise completed.

On Friday, the agency announced Khatri's resignation, but said his departure had nothing to do with his criticism of the backlogs. A spokesman said Khatri plans to return to the private sector.

Civil rights groups welcomed the change.

"It seems like a step in the right direction," said Julia Harumi Mass, a staff attorney with the American Civil Liberties Union's office in San Francisco.

The civil rights organization has filed several lawsuits on behalf of immigrants applying for citizenship who have had to wait for months and even years for their applications to be processed because of the FBI checks. The group contends that the databases the bureau relies on are riddled with errors that lead to the delays.

Although acknowledging that the process is slow and cumbersome, Jessica Vaughn, a senior policy analyst with the Center for Immigration Studies, a Washington organization that supports stricter immigration controls, said the checks are necessary.

Vaughn said the agency had considered removing the FBI background checks before the Sept. 11 terrorist attacks.

"The thinking was that there were so few hits that they thought they could deal with a few bad apples," she said. "Of course, that was before 9/11 and they found out what would happen if just a few people got through."

Those who support the agency's change said the suggestion that it could create security problems are unfounded. That's because the FBI checks will continue and the immigrants can be deported if the bureau's investigation discovers a problem.

Frederick Hill, a spokesman for Rep. Darrell Issa, R-Vista, said the congressman supports the change because it speeds the process, but still deports the immigrant if he or she fails the background check. Hill added that Issa supports more funding to reduce the FBI backlog.

"We need to make playing by the rules a more attractive option," Hill said.

Instead, we are going to let lots of illiterate, low-skilled lawbreakers in, while the law abiding well-read never get through the quotas.

A recipe for the US winding up like Mexico and the rest of Latina America: Third World, run by bandits, and only capable of manual labor if I ever saw one.

Of course the aliens are complaining about a six month wait (while they collect welfare albeit), cause they don't want their criminal record to pop up before they get their GET IN FREE CARD! I am a born optimist, but I have lost almost all faith in these “leaders” to make smart and practical decision that benefit the majority of American Citizens. My Russian wife and I have been married for over 10 years. We spent the first 8 of them living in Russia. She is fluent in English, and a dentist with a PHD in Dental Research Two years ago we moved to the United States and she applied for her Green Card - she is still waiting for the FBI namecheck to be complete. She is in a state of limbo which they tell us could last for years.


The key here is that THESE PEOPLE ARE ALREADY IN THE COUNTRY LEGALLY AND THE NAME CHECK STILL CONTINUES. Think about that for a couple of minutes.

If they don't have jobs will they return to Mexico or stay here and go on the welfare roles? How much more will this burden our school systems? I don't mean to be xenophobic, but I just don't see how we can take care of all these people now that the economic boom has slowed down. We just don't need as many unskilled workers right now. It's sad but true. Also why does Mexico not take advantage of all of the outsourcing jobs? India is making a ton of money for its workforce with call centers. Remember during the last amnesty attempt, where the rule was that the government had exactly 24 hours to do a complete background check. Well that is because it is impossible for our bureaucratic government to do through background checks from people from who knows where. In order for background checks to be effective the host country must have a system in place that is just like ours, and we all know what a Joke that is. So forget the background checks. After all these are mostly people going through legitimate processing who may not have submitted paperwork if there were issues with them having back ground checks. Prior to announcing in June that they were going to get additional staff and raised the fees substantially to "pay" staff do you not think that these professionals should have anticipated the increase now causing the "backlog". These same fees that were paid are now being used as send backs to the taxpayers and the house buyers to subsidize the broken economy. Immigrants are always helping and contributing and has always been a good thing for America. Pay attention to more critical issues. This is one that is very easily resolved.

Shamnesty Bill wrote on Feb 16, 2008 2:37 PM:They can't finish background checks for months or years and the SHAMNESTY BILL called for a 24 hour check? I believe the check had to be done in 24hrs and if it wasn't, the person was allowed in. What a joke!

The process should be sped up for the ones who take the right road. I welcome all them: however, I deplore the ones who skirt our laws and steal in to our country!!

If we don't stop this garbage, we will, in less than 10 years become, like Mexico, a third world nation...and LISTEN carefully to candidates...they want to take YOUR money and give it to those who don't want to bother working for a living...Obama, with his black separatist pastor, has affinity for the people of Africa - and , I'm sorry, but Americans have a right to enjoy their income if they have worked hard to get it...the government has NO RIGHT to take it away from them to give it to welfare bums who prefer to lay around watching tv and living off the largesse of the productive citizens.
And watch out! Bush is doing a huge secret agreement with Mexico (which is why Calderon was here last week!) giving them - ARE YOU READY FOR THIS? $1.4 BILLION to 'secure their southern border"....WHAT??? He refuses to close OUR SOUTHERN BORDER but is giving Mexico OUR money to close THEIR border????while Mexican gangs and even Mexican troops are attacking OUR border patrol on an almost daily basis!

Wake up - fight back...do NOT allow this country to continue stealing from us to give to nations which have the wherewithal to easily support themselves//Mexico has OIL, has GOLD, has potential to be one of richest nations on earth...but corruption, graft have destroyed it...WHY should WE, THE PEOPLE continue to support them???
