Encinitas adopts beach smoking ban

The ordinance is expected to take effect in 30 days.

Councilwoman Teresa Barth said she supported the ban because she felt it was, first and foremost, a health issue.

"It's not just the secondhand smoke, but the cigarette butts become marine debris that doesn't biodegrade," she said prior to Wednesday's council meeting.

The three Encinitas council members who originally voted against the ordinance in 2004 -- James Bond, Dan Dalager and Mayor Jerome Stocks -- changed their position this time around.

Encinitas resident Candice Porter, who has lobbied for the ban since 2002, said at Wednesday's meeting that one reason the council members changed their stance was surveys presented by students from the Youth Tobacco Prevention Corp, a division of the San Dieguito Alliance for Drug Free Youth, that showed 85 to 90 percent of residents support the ban.

"We went up to people at Moonlight Beach and the Lumberyard, and they all said they wanted the ban," said Christina Litz, 17, who attended the council meeting with three other Torrey Pines High School students.

The vote was a victory for the activists from the student youth group, who have lobbied for a smoking ban at city beaches, parks and public areas for years.

"We've spoken before the Encinitas City Council before," Litz said. "We are all concerned about smoking at the beach because of the secondhand smoke and littering."

The youth group had lobbied for Encinitas and other North County cities to ban smoking at beaches and parks. Solana Beach, Del Mar and Oceanside have all approved similar bans.

Judi Strang, executive director of the San Dieguito Alliance, said that the final ordinance adopted Wednesday in Encinitas was more comprehensive than the original version, because it also bans smoking at beach access and outdoor dining areas.

Bond added before the meeting that he expects the ordinance to be self-enforcing, much like the ban on smoking in bars and restaurants is now.

"As far as we know, no one on Solana Beach beaches has resisted to comply (with the smoking ban)," Strang said. "Like lifeguards who tell people there are no dogs on the beach, now they will tell them to put that butt out."

Violation of the ordinance will be a misdemeanor and could carry a $100 fine. Permanent signs will be installed indicating that the area is a smoke-free zone.

Christopher Hazeltine, director of the city's parks and recreation department, said he will be ordering the signs immediately, noting that all Encinitas city beaches will soon be smoke-free, with the exception of state-run Cardiff State Beach.

And since the amount of smokers are decreasing but cancer rates are climbing, we can only assume the State is correct in this matter.

Banning this drug should have been done a long time ago... the human suffering it has caused is immeasurable, the cost in health care alone, should be recovered from the corporations that care more about profit than than the well being of fellow human beings... Lets BAN the sale of tobacco next!

Warning, it is dangerous to get between an addict and his/her drug... expect trouble..

Besides, the City does not OWN the beach. WE, THE PUBLIC, own the beaches. This ordinance was passed by the City Council and NOT the people. The City owns the right-of-way to access the beach, but not the strip of sand parallelling the water. Sounds ripe for a lawsuit against the City. I think I'll have my atty look into the matter. Oh please you smoker, do you drink the gas or put it in your body....its a warning to cover their ass from lawsuits if someone did.

Smoking causes cancer in smokers and second hand smokers. If you want to kill yourself and have a very pain full death go for it but dont try to take others around you. Oh hey I know maybe just quit and live a nicer life.

The bandwagon of local smoking bans now steamrolling across the nation -
from sea to sea- has nothing to do with protecting people from the supposed
threat of "second-hand" smoke.

Indeed, the bans themselves are symptoms of a far more grievous threat; a
cancer that has been spreading for decades and has now metastasized
throughout the body politic, spreading even to the tiniest organs of local
government. This cancer is the only real hazard involved - the cancer of
unlimited government power.

The issue is not whether second-hand smoke is a real danger or a phantom
menace, as a study published recently in the British Medical Journal
indicates. The issue is: if it were harmful, what would be the proper
reaction? Should anti-tobacco activists satisfy themselves with educating
people about the potential danger and allowing them to make
their own decisions, or should they seize the power of government and force
people to make the "right" decision?

Supporters of local tobacco bans have made their choice. Rather than
attempting to protect people from an unwanted intrusion on their health, the
tobacco bans are the unwanted intrusion.

Loudly billed as measures that only affect "public places," they have
actually targeted private places: restaurants, bars, nightclubs, shops, and
offices - places whose owners are free to set anti-smoking rules or whose
customers are free to go elsewhere if they don't like the smoke. Some local
bans even harass smokers in places where their effect on others is obviously
negligible, such as outdoor public parks.

The decision to smoke, or to avoid "second-hand" smoke, is a question to be
answered by each individual based on his own values and his own assessment
of the risks. This is the same kind of decision free people make regarding
every aspect of their lives: how much to spend or invest, whom to befriend
or sleep with, whether to go to college or get a job, whether to get married
or divorced, and so on.

All of these decisions involve risks; some have demonstrably harmful
consequences; most are controversial and invite disapproval from the
neighbours. But the individual must be free to make these decisions. He must
be free, because his life belongs to him, not to his neighbours, and only
his
own judgment can guide him through it.

Yet when it comes to smoking, this freedom is under attack. Cigarette
smokers are a numerical minority, practicing a habit considered annoying and
unpleasant to the majority. So the majority has simply commandeered the
power of government and used it to dictate their behaviour.

That is why these bans are far more threatening than the prospect of
inhaling a few stray whiffs of tobacco while waiting for a table at your
favourite restaurant. The anti-tobacco crusaders point in exaggerated alarm
at those wisps of smoke while they unleash the systematic and unlimited
intrusion of government into our lives.

We do not elect officials to control and manipulate our behaviour.

The more young people are exposed to smokers the more likely they will smoke. It is a destructive stupid habit but so addicting that stopping is a life long struggle -- by our example of not smoking our children will benefit.

My grandmother was diagnosed with emphazima several years ago...and guess what she never smoked a cigarette a day in her life...hmmmm wonder how that happened?

It's disgusting....however, I wish the trash problem on our beaches was merely limited to people leaving behind butts, but unfortunatley there are SOOO many people that leave there soda cans, candy wrappers, etc., behind as well. What the hell happened to pick up after oneself? Is it THAT hard?

So if I was to "litter" and drop it on the ground it could be very easily ground into nothing, but a bit of unnoticable tobacco remnants, and maybe a microbial bit of paper... Oh and AIR IS FREE! Unless you own the property, then I guess your paying for it... Just get over it people.. I still smoke on the "non smoking" beaches, nobody says anything to me about it... And I will do it on Encinitas as well, go ahead, say something... I'll put my buttless cigarette out on Encinitas beach.. The worlds supposed largest ashtray and cointinue walking away, relighting another after you have passed by...
