VISTA: DeJong sues city over proposed RV lot

VISTA ---- Arie DeJong, a colorful and sometimes controversial North County businessman, has sued the city of Vista, alleging it changed its zoning laws to block him from building an RV storage lot on a prime south Vista corner.

"I am taken aback at the lengths the city has gone to take away a permitted use of a private citizens land," said DeJong's attorney, Leigh Rayner, in an e-mail Sunday.

DeJong filed his lawsuit Thursday in Superior Court. The suit names the city, as well as its five-member City Council.

At issue is the council's decision on April 8 to require a special permit for new lumberyards, RV storage lots or other outdoor businesses in a handful of commercial areas. Previously, no permit was required.

The new rule does not explicitly prohibit specific types of businesses but it does give city officials an avenue to impose special conditions on projects, or scuttle them altogether.

The ultimate goal, Community Development Director John Conley told the council in March, is to clean up the city's commercial districts by making sure the projects that go in there look nice.

DeJong isn't buying it.

The rule change, he said, was just a thinly veiled attempt to kill his plan for an RV storage lot on the vacant 9-acre lot near Sycamore Avenue and South Melrose Drive.

DeJong said he first told city officials about his intentions in November, and within weeks, city staffers were rushing through the zoning code change.

City Attorney Darold Pieper did not immediately return a call seeking comment Monday morning.

In recent months, city officials haven't denied they have grander ambitions for the south Vista corner, which fronts a major intersection that accommodates more than 32,000 vehicles a day.

Councilman Bob Campbell told the North County Times in February that he has always assumed ---- based in part on discussions with DeJong ---- that a shopping center would one day take shape on that property.

In his complaint, DeJong accuses the city of making only a "meager, pro forma, and ultimately inadequate" attempt to analyze the environmental effects of the rule changes, as required by the California Environmental Quality Act.

He asks the court to set aside the council's decision.

DeJong owns properties throughout North County and his family started the Hollandia Dairy in San Marcos. He also helped found a Carlsbad trash company, Coastal Waste Management, as well as several other enterprises. Over the years, he has squared off with the city of San Marcos in several disputes about his businesses there.

Catch 22 wrote on Apr 21, 2008 3:57 PM:Here we go. Cities like Vista, Oceanside and Carlsbad pass laws on RV parking. Then they prohibit RV lots from being built where people now have to park. So where is everyone supposed to park their RV, boat,etc. when every local facility capable of parking these vehicles is full and has long waiting lists and you won't allow new ones to be built. You (the cities) can't have it both ways. Either repeal the parking restrictions or allow lots to be built.

Looks like Vista has taken lessons from San Marcos on how to treat its businesses. Over the years Mr DeJong was run through his traces every time he wanted to build or create something in San Marcos. The previous commenters obviously do not even begin to know him or of his generosity. San Marcos should give him an award because he cares about the people and puts his money where his mouth is. As far as the hurried EIR, I can just hope that the appropriate steps have been taken to protect the rights of the people.

He bought his property as commercial fair and square so let him develop it fair and square as he wants. You couldn't pay me to live in Vista!

Put an RV park somewhere secluded or hidden... there is no reason for a RV park to be in such a "main" area. Welcome to Vista...look at our wonderful RV park. Vista needs to clean up it's act and actually try to get some decent business. That's what they're doing. Good job.

I live in Shadowridge and we can pay $75/month to park our RV's in a designated / secure lot within our community. More communities should do the same. If you're thinking about getting an RV, make sure you know where you're going to put it. I'm glad they're not allowed on the street for over night parking... What a nightmare that would be.

I have worked in that area for years and the conduct of the residents never ceases to astound me. I have been approached during the course of my duties as a public employee and been told by HOA members "this is a private area, Do you have the associations permission to be doing this work?". You folks think "your" neighborhood is the taj mahal of north county or something. Get real. There is a gas station across the street, an industrial complex across the other street. Let him build the lot. Maybe you just don't want to lose your kid's dirtbiking spot or something. I do agree that people should consider where they are going to park something like this when they buy it.

I don't understand how a property was zoned for this and how the city of Vista can quickly change things ( or try too). Instead of having another strip mall-(alot more traffic) I think if a RV Park is esthetically appealing- then I say why not. In the city of Carlsbad,I saw a RV park on El Camino Real- you hardly knew what it was and it looked good... What the shame here is how the Vista is sneaky and pulls the rug when something is zoned for RV storage and then have Big Government change the rules.

Before you even purchase a house in Shadowridge, you must agree to the HOA rules and sign. If you don't like it, don't live there.

You must admit, if you drive through Shadowridge, it doesn't look like it was built in 1989, does it? I wonder why? Because there are "rules" to keep the "riff raff" out (or controlled).

I'm not a big fan of rules either, but I must admit, the simple rules that are in place keep the neighborhood looking great.

As a side note, I live in Shadowridge, but I'm an Oceanside resident, not Vista. No kids with dirt bikes either. Just the sound of RV makes me cringe because I've seen some pretty "broken" looking ones... I guess if the entire park is not "visible" anywhere from the street, it might be doable.

South Vista Family wrote on Apr 24, 2008 5:37 PM:We live in the area tagged as Shadowridge, but not in the planned development area. We do not have the regulations they have there, so people do park their boats and RVs and trailers in their yards... my neighbor has not moved his for over two years. At some point it becomes yard art. His comment is there no place to take it without driving a half an hour each way. Vista needs a place to park these things. I looked into the planned development. They are giving the city the corner with a fountain feature, as The City wants something nice there, so they will have that. The design of the parking lot is such that it totally screens the contents, I am told it will look like a nice gated community, walled for security. If they do that and you can not see the RVs, its okay with me. Looks like they put a lot of planning into it. My neighbors support it as it will not generate a lot of traffic, and will actually make the neighborhood it is next too safer and quiter, a good thing. Good to get the yard art out and clean up these neighborhood eye sores. This project has my vote of approval.
