ENCINITAS: District orders school to disprove allegations or face restructuring

Academy must provide documentation by May 30

ENCINITAS ---- If the Encinitas Union School District's only charter school can't disprove recent allegations of fiscal mismanagement by May 30, the district may order the removal of its administrators or revoke its charter, district officials said Wednesday.

"We're not at the point of revocation (of the charter) ---- we're at the point of discovery," said district Superintendent McLean King as he discussed the district's new request for documents from the Theory Into Practice Academy.

Late Tuesday afternoon, the district sent a 14-page letter and some 150 pages of accompanying documents to the school's leaders. The letter lists a series of allegations of fiscal mismanagement and conflict of interest violations, and requests more than a dozen different types of documents, including everything from tax records to academy board meeting minutes:

Michael Hazelton, the academy's director of operations and development, said Wednesday that the school will supply all the documentation the district requires in order to prove that it has not engaged in any illegal behavior.

"We have nothing to hide," he said, noting that academy leaders have met with lawyers regularly since the school was founded to make certain that all of their dealings were above board.

The Theory Into Practic Academy ---- established by a group of people interested in the needs of intellectually gifted children ---- had 271 students in kindergarten through sixth grade as of Wednesday, officials said. It shares a campus on Melba Road with Ocean Knoll Elementary.

As a charter school, the academy has special status in the state education code. It receives public funding but doesn't have to follow some of the requirements placed on regular public schools.

However, the district superintendent said, there are state laws that charter schools must follow just as all other entities that accept public funding.

"Charter schools are not exempt from the Brown Act (the requirement that their meetings must be conducted in open-to-the-public sessions) and they're not exempt from conflict of interest laws," he said.

In its "notice of remedy" to the school, the district declares that it has evidence that these laws may been violated at the academy. The allegations include:

-- That at least four of its board members obtained paid employment or consulting positions with the academy concurrently with, or after, becoming board members.

-- That both Hazeltons influenced the board's decision last year to hire Michael Hazelton at a salary of $110,000. He may have been acting as board president during this period, the district's letter states.

-- That founding members of the academy's board, including the Hazeltons, also formed and served on the board of a separate nonprofit organization known as TIP Education, which could have financially benefited from the charter school.

-- That the academy may have violated "corporate self-dealing" laws because a majority of the board members appeared at times to have directly benefited, or have relatives who directly benefited, from the board's financial decisions.

Meanwhile, parents with children at the school have been divided over the situation.

Hazelton supporters say parents who oppose the Hazeltons have sought to make trouble for the school because they are unhappy that the academy won't offer a junior high program this fall. Hazelton critics say the supporters have their heads in the sand and are refusing to see any administrative problems at the school because the classroom instruction is so good.

Ginger Relyea, a parent who has been pushing for an investigation into the school's management, said she pulled both of her sons out of the academy Wednesday and began home-schooling them.

"I am concerned about the treatment of my children should they continue to attend TIP Academy," she said. "I don't want to risk it."

Parents who support the school say her reaction is completely unjustified.

"That's rubbish, that's crazy," said Tim Cusac, who has two children enrolled at the school and spoke in favor of the school's administration at district board meeting Monday.

Michael Hazelton stressed Wednesday that there would always be a strong separation between what happens in children's classrooms and the district investigation issue.

"The two will not mix," he said.

Mike is well rooted and has a lot of experience with VUSD and has worked wonderfully within the charter school he jumped started, Guajome Park Academy.

The Vista Unified School District also has some brand NEW open school district facilities for RENT and you don’t even have to worry about conflict of interests, charter bylaws, curriculum, or state standardized testing. You will fit right in and Mike has a lot of underground friends there too.

Dr. King was nice and didn't say anything to scare anyone. Cathy Regan was really professional. The other board members seemed to be acting like concerned parents in the community, and they listened to everyone's comments. There were no crazy TIP parents, not at all like they were portrayed in previous blogs; just people who cared about their kids. That Hazelton guy lied to the parents at the school by telling them 200 people were there. Maybe 100 at best. And then he said EVERY person raised their hand in support of TIP Academy. I didn't. And I was sitting right behind him. The Mom sitting next to me didn't raise her hand either. I don't trust him. He seems a little righteous, but I admit I don't know him personally. I tried looking in the MOU for the restriction on hiring by TIP of TIP board members, I did not see it. I'll keep on looking.

Don't let these nasty blogs be seen as anything else but scare tactics. Yes the remedy seemed lengthy and scary, but read deeper into it. They truely are just allegations that have little merit and will be addressed soon. Relax! The nastiness here needs to end!

Have you not seen the MOU saying that in order for a director to be terminated, then the TIP Education must approve it? And, who is on the TIP Education? Well, you guessed it. And how about the part that states that Mike was the president of the board when he hired himself. Great! That works well for him. These are not issues to be concerned about, these are true legal charges that could lead to arrests. Anyone with a law degree out there can comment on that. As a TIP parent, I have seen enough, and read the remedy completely through, and I am no longer in support of our administrators. They are not acting in the best interest of the kids or the teachers.

VUSD is renting brand new school facilities to charter schools. They will accept the entire TIP Academy and room for hundreds more. They don’t have to comply with any state or federal laws so you don’t have to worry about complaints. If in doubt check out Guajome Park Academy, the proof is in the pudding.

If you go to the “great schools” website you will find that a copy of the Guajome Park Charter is posted. What it means is that many charter schools take these bylaws and format them on to their own charter/petition/bylaws.
Just because a contractual agreement is signed between a school district and a charter school does not create legitimacy, particularly if there are violations of the law in the contractual agreement.

To the contrary if the school districts find out that there are violations then the contractual agreement becomes null.

Each reaction depends on the situation. Both are human reactions that satisfy physical and emotional needs. Crying is not always a "bad" reaction, nor is laughing always a "good" reaction.


While crying can release stress and overloaded emotional wells, so can laughter! You release chemicals in your body called endorphins when you belly laugh that lift your mood, lower your blood pressure, lower your stress level- and a side affect of a belly laugh is usually other people laugh too!

So don't take these blogs personally, it's just humans reacting differently to a tragic situation.

I read that the Vista Unified School District has NEW SCHOOL FACILITIES for rent. VUSD loves charter schools they even built a brand new building for their award winning school Guajome Park Academy to which, Mike, Debbie and some of the TIP petitioner were board members and teachers of the charter simultaneously.

In Vista we don't have to make any changes or corrections, we will fit right in.

A leader is responsible for the absolute overall outcome/success of the organization measured by multiple metrics. It requires you to be balanced and capable of managing/handling all aspects that are critical to the success of the organization. Doing some leadership responsibilities flawlessly do not counter balance for poor performance or limited attention to other critical responsibilities.

Historically, many organizations have succeeded or failed due to how well balanced and competent the leadership is. Having innovative products, great intentions, suburb R&D, execution, governance, financial modeling and proper planning is not enough, it takes leadership to manage those aspects with coordination and balance. We have all witnessed companies, teams and organizations with outstanding products, participants and ideas fail due to poor balance and competence at the leadership level. Simply put, to be successful and have longevity, a leader needs to be able to lead the other internal leaders and stakeholders.

My child is at TIP; this has been a breakthrough year for him on a variety of educational and emotional levels for his development that had not happened prior to arriving at TIP. I attribute this outcome to his teacher and the TIP learning environment and curriculum. While the TIP educational product is outstanding, I stand in criticism on the front office/TIP Board leadership as it relates to managing the business, governance and financial and planning aspects of TIP.

I have spoken and written support of my stance publically to the TIP Board and leadership…it is time for other parents and interested parties to identify and agree that improvement/corrective action is critical to support TIP’s longevity, public funding requirements and general successful practices. Read the facts attached in the Letter of Remedy.

It's scary when the instructors of our children understand so little of the basic principle of our ethics. Shouldn't the district prove the allegations instead of the accused being required to prove they are innocent?

The earlier poster was correct. In all but kangaroo courts, it is incumbent on the accuser to prove that the accused has done wrong. Allegations are not proof of wrong doing.

Of course, no one will mistake this circus for a real court. This is a power play by the EUSD and Mr. King and his merry band of attorneys.

As of today they are saying that a restructuring is needed. It's only a matter of time before that language gets changed to a remedy of closure. The agenda is clear.

The school promotes tolerance of others -- culture, ideas, looks, etc. There is no school in the EUSD that can match what TIP offers. The values taught at this school start with the administration. The EUSD could learn a thing or two from TIP if they wanted to.

I do know some TIP parents who really love their teachers and curriculum, and I feel sad for you because, after reading the NTR and researching the Cal.Ed.Code, my legal opinion is that there exists more than enough evidence to revoke TIP's charter. In fact, EUSD would have a responsibility to revoke TIP's charter given the number and severity of the offenses involving misuse of public funds.

Paraphrasing Cal. Education Code section 47607(c): To revoke a charter, there needs to be "substantial evidence" of ANY of the following: (1)material violation of ANY conditions, standards, or procedures of the charter; (2)failure to meet any pupil outcomes; (3)fiscal mismanagement or failure to meet generally accepted accounting principles; OR (4) ANY violation of law.

Only ONE condition above is required for revocation. EUSD has substantial evidence right now to revoke TIP's charter based on THREE conditions,(1)charter violations; (3)fiscal mismanagement; and (4)violation of laws.

The evidentiary standard here is "substantial evidence." This is not a civil lawsuit for money damages where the standard is a "preponderance of evidence" or a criminal proceeding where evidence must be "beyond a reasonable doubt" and the accused is innocent until proven guilty.

Sorry to be the messenger of bad news for TIP parents but I felt someone had to explain the law to correct the nonsense posted above by "Just Passing By" and others.

They all belong to the same Joint Powers of Authority Pool with the SDCOE in their SELF JPA? TIP is a small fish and Guajome is a BIG SHARK in the POOL POND. Get it? heh, heh, heh,

If in fact they were all dragged into a real court they may all end up with stripes.

Anytime you get lawyers involved, especially when they are researching and writing a 163 page document it is costly. Ask yourself if they would be spending this much money, under these budget conditions if they were not absolutely sure the had a solid case? Use your common sense.

Facts about Charter Schools and Conflict of Interest Codes wrote on May 8, 2008 8:14 PM:Talking about the LAW recently the California Charter School Association got Assemblywomen Bonnie Garcia, R-Cathedral City, to carry a bill that would address concerns about conflicts of interest on charter school boards, but still let those with a financial stake in a school serve on its board.
However the Charter School Association was thrown for a loop when the bill it asked a legislator to carry ended up being much more restrictive than expected.

Garcia heavily amended the bill last month to reflect the concerns of the Assembly Education Committee. Now, the association is opposing the bill it had sponsored.

In his annual address The San Bernardino County superintendent of schools Herbert Fischer, said that new legislation was needed to address abuses such as those at the California Charter Academy, which is now defunct. The Victorville-based charter school network operated four schools and more than 50 satellite sites, including campuses in San Bernardino, Colton and Rialto, before it closed in 2004.

In September, a grand jury handed down a 117-count indictment against the school's founder, Charles Steven Cox, and Tad Theron Honeycutt, a Hesperia councilman who ran businesses connected to the schools.

The Cox group is accused of illegally transferring $5.5 million from the academy to private, for-profit management companies they created to sell supplies and services back to the school.

Honeycutt and Cox have pleaded not guilty to misappropriation of public funds, grand theft and FAILING to FILE TAX RETURNS, (sounds very familiar to the North County.)

Garcia's bill, AB 1772, originally would have required that no more than 49 percent of a charter school's board be made up of staff or those with a financial interest in the school. Is the SDCOE conflict of interests requirement codes allied with the laws proposed by the California Legislation?

The new version of the bill would prohibit charter school board members from holding any financial interest in the school. The San Bernardino County Superintendent of Schools office and the California School Boards Association support holding charter school boards to the same standards as public school district boards.

Some representatives, for San Bernardino County's Superintendent of Schools office and for school districts around the state, say it's highly unusual for a sponsor to ask a legislator to carry a bill, and then withdraw its support.

This bill requires charter schools to adopt and comply with a conflict of interest policy that includes the requirement that its governing board members abide by the SAME conflict of interest requirements AS LOCAL EDUCATION AGENCY (LEA) GOVERNING BOARD MEMBERS, as specified. CHARTER SCHOOL GOVERNING BOARDS SHOULD BE subject to the same laws governing conflict of interest applicable to traditional public school boards."

Sorry TIP wrote on May 8, 2008 8:27 PM:Looks like TIP should have taken the money spent on Mike Hazelton and used it on somebody who could more effectively fought the (likely) hundreds of thousands that the EUSD spends on eliminating perceived threats. Too bad the kids of TIP lose what their parents think is a great education. Worse yet, EUSD demonstrates that it cares more about the survival of the status quo over the needs and desire of its customers, the parents paying taxes.

EUSD wrote on May 8, 2008 9:40 PM:Money going out is not EUSD's fault, it is Mike and Debbie Hazleton's fault. They are the ones that are costing the district basic aid funding and attorney's fees. I am thankful that the district is doing its due diligence, abiding by the law and being proactive. Yes, they maybe being forces to spend money now, but it will cut the long term losses from the charter school/basic aid funding for the future.

Just think of the incredible GATE program we could have with all of this money.

I think it is laughable that TIP parents are being recruited by other charter schools - we are supposed to be supporting of eachother but instead of helping each other out during times of crisis - some charter schools circle like vultures! Julian Charter schol is notorious for this, Greater san Diego academy does it and now it seems as GPA follows suit. Show some restraint charters - if educating children is really what it is about, then back off trying to build your enrollment numbers.
While it does seem like the current administration is done, it doesn't mean the the entire school is.

To Lawyer: a lawyer is the last one to ask about the law. In every courtroom since the establishment of law there has been two lawyers arguing opposite positions of the law and facts.

My point is simple, requiring someone to prove they are innocent is repugnant to all but a lawyer's sensibilities. Your position is questionable when you require someone to prove they are innocent instead of you proving they are guilty.

If you have the facts, make them stick and revoke the charter.

Your second point is that a person entrusted with other people's money and other people's children must be proven guilty before they are fired. Using your standard, you'd be okay with sending your kids to a school where there was substantial evidence that a school employee was, for example, a child molester. Hey, the school hasn't proven him guilty so the school can't fire him yet, right?

How about the school administrator entrusted with all the money meant for your children's school? If there is substantial evidence he is financially incompetent to run a school, and that he has unlawfully taken money from a charter school before (Cortez Hill Academy), he should be fired. Should the school board continue to fork over millions to this guy until he is proven guilty in a court of law? I wouldn't re-elect any EUSD board member that didn't fire Mike, then sue him to recover funds he took under an unlawful contract (Mike's coerced salary package). The innocent until proven guilty part doesn't come into play until he is indicted on federal tax charges.

By the way, check out the very bottom of page 70 of the NTR (Cortez Hill Academy's demand that Mike return $18,350 salary that he took w/o Board authorization). Mike even stole their slogan!

How many times people can hear the same old excuse? The simple truth is that they will cover up as they are trying to recreat the documents! Wouldn't you have done Form 700 then, not right now? I too wonder if the parents that are against the TIP academy are opposed to the structure of the charter school with its incestuous relationships, appearance of impropriety and perhaps possible commingling of funds/board capacity.

Based on some of these blogs it appears that some individuals are very ignorant about the issues they speak of their, “ own community” “the TIP academy taking funds from our City's school district” and so forth all of these allegations are unfounded and cannot be proven to be true.

It saddens me that people who believe to be so educated and elite are so ignorant about the issues at stake. How can such an affluent community be so ignorant and closed minded? If anyone truly wanted to file a complaint and/or civil action based on these issues against EUSD, they sure have a good cause of action. This type of thinking is a good way to loose PUBLIC FUNDS.

I am still wonder how can EUSD have so many gifted students and their parents so closed minded and ignorant?

I have personally read some well balanced articles he has written on charter schools and frankly, I think that he is well respected through out the state.

Here is the problem Paul C. Minney is also the attorney of Guajome Park Academy.
Anyone who knows about the Guajome Park Academy dealings has got wonder what in the world is going on here? Please anyone doing any serious research look up the structure of Guajome Park and compare the BOD makeup to TIP and read for yourselves.
