REGION: Holes in Horn's story raise doubts
Supervisor says meeting with developer was legal, appropriate

New details about a meeting between county Supervisor Bill Horn and the chief executive of a wireless company with a controversial cell-tower project before the county government have cast doubt on the supervisor's credibility and raised questions about the legality of the meeting.
Various sources have contradicted Horn's account of the meeting, as described in an e-mail his spokesman sent to the newspaper last week and on his Fifth District Web site.
The supervisor has not been accused of breaking any laws, but his critics have said the meeting smacks of impropriety and may violate county guidelines.
In August, Horn met with Doug Hutcheson, president of Leap Wireless, the parent company of Cricket Communications, which in 2006 asked for permission from the county to build a hotly contested, 50-foot-tall cell phone tower in the historical Park Hill Lane neighborhood just outside the southeastern border of Escondido. All told, Cricket's lobbyist said last week, the company has roughly 20 applications to build cell towers in the unincorporated county. Potentially, any application could come before the Board of Supervisors.
Horn's official spokesman, John Culea, described the meeting as a casual "meet-and-greet," and said the cell tower project wasn't mentioned. However, the meeting was attended by Horn's land-use policy adviser, Dustin Steiner, and registered Cricket lobbyist Craig Benedetto.
Horn, who is scheduled to vote on the project in June, refused to be interviewed for this story.
But last week, the supervisor defended his meeting and criticized the North County Times in an e-mail to constituents and in a new feature on the county's Web site called "The Whole Story." Among other things, Horn said all four of his fellow supervisors had also met with Hutcheson.
However, county supervisors Ron Roberts, Greg Cox, Dianne Jacob and Pam Slater-Price all said through their top aides this week that they had not met with either Hutcheson or Benedetto.
What's more, aides for supervisors Jacob and Slater-Price asked Horn's staff Monday to correct or strike the faulty information from Horn's Web site.
As of late Thursday, the site still included Horn's assertion that the other four supervisors had all met with the developer and the lobbyist.
Horn has long been dogged by a reputation for being more accessible to developers and executives than to the residents he represents.
He has tried to deflect such criticism, saying he was too busy to meet with everyone in his district, which encompasses much of North County, and that his staff is available to meet with constituents.
Even so, Horn's decision to include a Cricket lobbyist and a county land use planner in his meeting is troubling, said Bob Stern, president of the nonprofit watchdog group Center for Governmental Studies and former general counsel for the California Fair Political Practices Commission.
Stern deemed far-fetched Horn's insistence that the cell phone tower never came up in the supervisor's discussion with Hutcheson and Benedetto.
"Obviously, (the meeting) was more than an introduction," he said Wednesday. "Otherwise, you're wasting everybody's time" by including both Horn's land use adviser and Hutcheson's lobbyist.
According to the county's Administrative Code, supervisors are prohibited from discussing a project with the developer or anyone else if it requires a hearing by the Board of Supervisors.
Cricket's cell tower project was approved by the county Planning Commission in December, but Park Hill Lane residents paid the $500 fee to appeal the approval to the Board of Supervisors. Horn's meeting with Cricket officials took place before the appeal had been filed.
The county's meeting rules are vague and open to a certain amount of interpretation, according to county legal officials.
They said, however, that because Planning Commission decisions can be appealed, they have recommended that supervisors refrain from meeting with any applicants whether their projects are coming before the board or not, to avoid rumors of back-room deals.
Stern said he would give elected officials the same advice.
Even if the cell tower didn't come up in conversation, Horn's decision to meet with Cricket executives "showed blatant disregard for the spirit of the law, at least," he said.
Horn's office has vehemently denied that the supervisor's meeting with Cricket officials was inappropriate or illegal. But the question could hinge on what qualifies as a "meet-and-greet" ---- an insiders' term for a brief introductory meeting with a supervisor devoid of any discussion of specific projects.
Supervisors routinely list casual introductory visits as meet-and-greets on their calendars as a way to distinguish them from meetings for official business.
Developers and executives seeking to build projects in the county are usually granted the brief, introductory meetings with an aide instead of an elected supervisor to avoid even the appearance of corruption, said several county officials.
Supervisor Jacob said that's precisely why she avoids such meetings.
"I do not meet or discuss with parties ---- for or against ---- a land-use project to be decided by the board once any application is on file with the county," the East County supervisor said Wednesday.
Also in question is how long the developer met with Horn.
According to Horn's e-mail and Web site, his meeting with Cricket representatives was a "standard meet-and-greet" appointment that lasted about 10 minutes.
"That is why the calendar states 'meet and greet,'" wrote Culea, Horn's spokesman, in an e-mail to the North County Times and to constituents on his "Whole Truth" Web page.
But a review of Horn's daily calendars lists the meeting with Cricket officials as a standard meeting scheduled for 60 minutes. Other appointments in the calendars were designated as "meet-and-greet."
The discrepancy suggests to Stern and others that his meeting with Cricket could have included discussions about the cell phone project.
Cricket's lobbyist, Benedetto, said Wednesday that he didn't remember what was discussed during his meeting with Horn, except to say that the Park Hill Lane project didn't come up. However, he appeared to confirm Horn's calendar entry that recorded a lengthier meeting.
Asked how long the meeting was, Benedetto said, "I don't know. Brief. Maybe 30 minutes."
"We didn't do anything wrong," he said. "We're not trying to get any undue influence."

Now what you do is schedule a meeting with his staff and discusses the project….! This is the best way to update his office of your concerns… Mr. Benedetto is a lobbyist and he should have known better to lie about an elected officials. Horn and his staff are stand-up people!
