STATE: California's top court legalizes gay marriage

SAN FRANCISCO -- California's Supreme Court declared Thursday that gay couples in the nation's biggest state can marry -- a monumental but perhaps short-lived victory for the gay rights movement that was greeted with tears, hugs, kisses and at least one on-the-spot proposal.

Same-sex couples could tie the knot in as little as a month. But the window could close soon after -- religious and social conservatives are pressing to put a constitutional amendment on the ballot in November that would undo the Supreme Court ruling and ban gay marriage.
"Essentially, this boils down to love. We love each other. We now have equal rights under the law," declared a jubilant Robin Tyler, a plaintiff in the case along with her partner. She added: "We're going to get married. No Tupperware, please."
In the Castro, long the center of the gay community in San Francisco, Tim Oviatt wept as he watched the news on TV. "I've been waiting for this all my life. This is a life-affirming moment," he said.
By the afternoon, gay and lesbian couples had already started lining up at San Francisco City Hall to make appointments to get marriage licenses.
In West Hollywood, supporters were planning to serve "wedding cake" at an evening celebration.
James Dobson, chairman of the conservative Christian group Focus on the Family, called the ruling an "outrage."
"It will be up to the people of California to preserve traditional marriage by passing a constitutional amendment. ... Only then can they protect themselves from this latest example of judicial tyranny," he said in an e-mail statement.
In its 4-3 ruling, the Republican-dominated high court struck down state laws against same-sex marriage and said domestic partnerships that provide many of the rights and benefits of matrimony are not enough.
"In contrast to earlier times, our state now recognizes that an individual's capacity to establish a loving and long-term committed relationship with another person and responsibly to care for and raise children does not depend upon the individual's sexual orientation," Chief Justice Ronald George wrote for the majority in ringing language that delighted gay rights activists.
Massachusetts is the only other state to legalize gay marriage, something it did in 2004. More than 9,500 gay and lesbian couples in that state have wed. The California ruling is considered monumental by virtue of the state's size -- 38 million out of a U.S. population of 302 million -- and its historic role in the vanguard of the many social and cultural changes that have swept the country since World War II.
California has an estimated 108,734 same-sex households, according to 2006 U.S. Census figures.
"It's about human dignity. It's about human rights. It's about time in California," San Francisco Mayor Gavin Newsom, told a roaring crowd at City Hall while pumping his fist in the air. "As California goes, so goes the rest of the nation. It's inevitable. This door's wide open now. It's going to happen, whether you like it or not."
Unlike Massachusetts, California has no residency requirement for obtaining a marriage license, meaning gays from around the country are likely to flock to the state to be wed, said Jennifer Pizer, a gay-rights attorney who worked on the case.
The ultimate reach of the ruling could be limited, however, since most states do not recognize gay marriages performed elsewhere. Nor does the federal government.
The conservative Alliance Defense Fund said it would ask the justices for a stay of the decision until after the fall election in hopes of adding California to the list of 26 states that have approved constitutional amendments banning same-sex marriage.
"We're obviously very disappointed in the decision. The remedy is a constitutional amendment. The constitution defines marriage as a union between one man and one woman," said Glen Lavy, senior counsel for the organization.
Randy Thomasson of VoteYesMarriage.com, a campaign to amend the California Constitution to ban gay marriage, said the decision was in effect telling children that they have a "new role model -- homosexual marriage, aspire to it.
"This is a disaster," he said.
Opponents of gay marriage could also ask the high court to reconsider. If the court rejects such a request, same-sex couples could start getting married in 30 days, the time it typically takes for the justices' opinions to become final.
The justices said they would direct state officials "to take all actions necessary to effectuate our ruling," including requiring county marriage clerks to carry out their duties "in a manner consistent with the decision of this court."
The county clerk's office in Los Angeles issued a statement saying it was awaiting legal analysis of the ruling and a timeline for implementation.
The case was set in motion in 2004 when Newsom threw City Hall open to gay couples to get married in a calculated challenge to California law. Four-thousand gay couples wed before the Supreme Court put a halt to the practice after a month.
Two dozen gay couples then sued, along with the city and gay rights organizations.
Gareth Lacy, a spokesman for Attorney General Jerry Brown, whose office argued to uphold the ban, said Brown will "work with the governor and other state agencies to implement the ruling."
Thursday's ruling could alter the dynamics of the presidential race and state and congressional contests in California and beyond by causing a backlash among conservatives and drawing them to the polls in large numbers.
A spokesman for Republican John McCain, who opposes gay marriage, said the Arizona senator "doesn't believe judges should be making these decisions." The campaigns of Barack Obama and Hillary Rodham Clinton said they believe that the issue of marriage should be left to the states.
Ten states now offer some form of legal recognition to same-sex couples -- in most cases, domestic partnerships or civil unions. In the past few years, the courts in New York, New Jersey and Washington state have refused to allow gay marriage.
Outside the San Francisco courthouse, gay marriage supporters cried and cheered as news spread of the decision. Jeanie Rizzo, one of the plaintiffs, called Pali Cooper, her partner of 19 years, via cell phone and asked, "Pali, will you marry me?"
Shannon Minter of the National Center for Lesbian Rights said same-sex marriage advocates could not have hoped for a more favorable ruling by the Republican-dominated court. "It's a total victory," Minter said.
James Vaughn, director of the California Log Cabin Republicans, called the ruling a "conservative one."
"The justices have ensured that the law treats all Californians fairly and equally. This decision is a good one for all families, gay and non-gay," Vaughn said.
California already offers same-sex couples who register as domestic partners many of the legal rights and responsibilities afforded to married couples, including the right to divorce and to sue for child support.
Citing a 1948 California Supreme Court decision that overturned a ban on interracial marriages, the justices struck down the state's 1977 one-man, one-woman marriage law, as well as a similar, voter-approved law that passed with 61 percent in 2000.
The chief justice was joined by Justices Joyce Kennard and Kathryn Werdegar, all three of whom were appointed by Republican governors, and Justice Carlos Moreno, the only member of the court appointed by a Democrat.
In a dissent, Justice Marvin Baxter agreed with many arguments of the majority but said that the court overstepped its authority and that changes to marriage laws should be decided by the voters. Justices Ming Chin and Carol Corrigan also dissented.
California's secretary of state is expected to rule by the end of June whether the sponsors gathered enough signatures to put the gay-marriage amendment on the ballot.
Republican Gov. Arnold Schwarzenegger, who has twice vetoed legislation that would have granted marriage to same-sex couples, said in a statement that he respected the court's decision and "will not support an amendment to the constitution that would overturn this state Supreme Court ruling."

If your church, mosque or synagogue does not want to open there doors to same sex marriage, not very tolerant if you ask me, then so be it. But a civil contract called marriage seems O.K. to me.
I feel I should keep my nose out of other peoples marriage decisions and leave the gay people alone already.

I hope not! This will be good blogging for weeks if not months to come. Of course for the huge majority of Californians, this decision will not noticably effect their lives. Gas prices and the recession are really more pressing issues but they aren't as "interesting" are they? I can't wait for the wedding to resume.

We are way too busy working 2 jobs to pay off those loans (we never could afford in the first place) to have this even be a small blip on our radar screen. The problem is that it must be done by a change to the CA Constitution. What it is all abut is tax evasion, and I wouldn't advise anybody to start counting their money yet.

The California Marriage Protection Act will likely qualify for the November 2008 election, based on the 1.1 million signatures that its organizers submitted. Its organizers can also petition the Court in the next 30 days for a stay of the Court's order, pending outcome of the people's vote on the Constitutional Amendment in November.

REALLY, Do you have any sense of compassion. Gay folks are attracted to other of the same sex because they are wired this way,born this way. Public licenses can be limited by the applicants ability (such as a drivers license) but not by race, sex, religion, sexual orientation or any other available means of discrimination. As long as the people applying for the marriage license are legal taxpaying citizens there is no reason it should be denied. As far as the church goes ... if you don't want to marry same sex couples then don't. That is your right. They can go to the JP that their tax dollars also pay for.

If another ban law gets passed in November, it will be challenged and if the challenge is based on the violation of the Constitution by said law, it will be overturned. And the next and the next. As I have said many times before, if you want to be able to pass a law that violates the Constitution, first you must Amend the Constitution to allow the law to pass. It really is that simple. I am happy that now I can marry any person of my choosing. It is gratifying to know that a Proposition that was past almost a DECADE ago was finally acknowledge as being unconstitutional. I have yet to hear one good argument as how me being able to marry my partner is going to affect society negatively. As in every other day I will go to work go home, make dinner for my family, walk our dogs, and watch a little television. Please tell me how my life affects yours or the traditional family values you claim it affects. I thought I was doing the normal family lifestyle. Today I know how it must have felt in 1948 when interracial marriages were found unconstitutional, the world didn’t come to an end then and it will not now. I will be celebrating tonight at home with my family and tomorrow going to work, who knows I might see you, after all I could be your doctor, a police officer, or your banker.

Setting aside the emotions of same sex marriage here is the reasoning behind the SC ruling. You can agree or disagree with the majority view of the court paraphrased below but to disagree you need to punch holes in the clearly stated reasons contained in the opinion.
1)First, the exclusion of same-sex couples from the designation of marriage clearly is not necessary in order to afford full protection to all of the rights and benefits that currently are enjoyed by married opposite-sex couples.
2) Second, retaining the traditional definition of marriage and affording same-sex couples only a separate and differently named family relationship will, as a realistic matter, impose appreciable harm on same-sex couples and their children, because denying such couples access to the familiar and highly favored designation of marriage is likely to cast doubt on whether the official family relationship of same-sex couples enjoys dignity equal to that of opposite-sex couples.
3) Third, because of the widespread disparagement that gay individuals historically have faced, it is all the more probable that excluding same-sex couples from the legal institution of marriage is likely to be viewed as reflecting an official view that their committed relationships are of lesser stature than the comparable relationships of opposite-sex couples.
4)Finally, retaining the designation of marriage exclusively for opposite sex couples and providing only a separate and distinct designation for same-sex couples may well have the effect of perpetuating a more general premise — now emphatically rejected by this state — that gay individuals and same-sex couples are in some respects “second-class citizens” who may, under the law, be treated
differently from, and less favorably than, heterosexual individuals or opposite-sex couples.

Obama will also bring unprecedented numbers of youg voters with him - the millenials - and guess what - this is a non-issue for them. They are concerned about the war, the economy, and the environment. They don't understand why there isn't same sex marraige already! I really look forward to seeing how this new generation will tackle the problems of their day and how they will shapw the world. These people love their pets, sometimes it seems more than their own children, because their pets offer them UNCONDITIONAL love which is mutually returned. So it's wrong to discriminate against two men, but it's OK for you to discriminate against animal lovers and their differing lifestyle and sexual orientation? Are you going to quote some Bible verse that says it is wrong? Show some tolerance and celebrate this diversity!

This is not an accurate descrition of the SC opinion. Read the ruling. The SC said...1) gay marriage rights do not affect opposite marriage rights. 2)Civil Unions are not equal to marriage and harm gay couples and their children 3)Banning gay marriage says that the State believes gay relationships do not have equal value/stature 4)Only retaining marriage for opposite sex couples sanctions the notion that gay folks are second class citizens and importantly the state emphatically rejects this notion.
If you can you need to refute this ruling and the logic behind the statements. You can not rely on religion because the state SC does not and will not, pesky seperation of church and state matter, so the SC does not care.

We are gradually overcoming our prejudices and becoming more enlightened & free, but it's never easy. There was backlash after slaves were freed, and after women were supposedly given full rights. Two steps forward, one step back. Those who oppose gay marriage represent "the dead hand of the past", including those whose politics and morality are determined by ancient books.

Maybe I'm cynical a little but I gather this is all a play to lure the conservative voters to the polls in November for another election they may not be willing to vote in otherwise. Take a look at history, Rosa Parks, Fair but Equal, the right for Blacks to vote (it was against the law for blacks to vote until 1943) and the court overturned these backwards law inspite of the majority of public opinion. And guess what, it all turned out fine. If gays are allowed to marry, but deal. It will be a non-topic in ten years.
If we put half the energy into education that we put into gays, we would be at the top of the country and not 48th at the bottom.

This is definitley a way to silence the voices of a democracy. This is a shame. Ammmend the Constitution and send a message to the 4 judges that their vote means NOTHING and then we will have EQUALITY as they are trying to create.
