OCEANSIDE: Lifeguards get extra police power

OCEANSIDE ---- The long arm of the law might soon be sporting a better suntan.

City Council on Wednesday gave more lifeguards the authority to issue citations for a handful of infractions, such as smoking on the beach, possession of a glass container or urinating in public.

The rule change, which requires a routine second vote, won't take effect until next month.

In asking for the extra power, Ray Duncan, the city's manager of harbor and beaches, said repeat offenders flout the law because they know lifeguards can't issue citations.

"We want to be able to handle it without having to call the police down," he said.

Under current city rules, only two members of the lifeguard service ---- the captain and lieutenant ---- can issue citations. The new guidelines would bump that number to seven by adding the chief and the four sergeants. If the city ever hires permanent lifeguards (most are seasonal), they would get ticket books as well.

"This is not a full-on armed officer down there," Duncan said. "It just gives them the citation authority that they need to perform their job."

The added power won't be granted to seasonal staff, which constitute the bulk of the lifeguard service. But if those lifeguards witness an infraction, they could just call over a supervisor, Capt. Bill Curtis said.

Asked why his department wants the extra responsibility, Curtis gestured toward several vacant properties near the coast where large hotels and condominiums towers are expected to take shape.

"We have to prepare for what's coming in," he said.

He hopes, he said, that it won't take too long for rule-breakers who frequent the beach to get the message, so lifeguards won't have to pull out their pens too often.

On Wednesday, Councilman Jack Feller jokingly asked that the KOCT TV camera in council chambers focus on a small group of lifeguards in the back of the room so that rule-breakers would know "these guys are going to be down there, making them eat their cigarette butts."

Though the council's vote was unanimous, there was some concern about lifeguards' focus drifting away from the water if they take on extra duties.

"In the past, we have been advised that we don't want lifeguards to be having to cite people," Councilwoman Esther Sanchez said.

She cautioned: "This is a change. Be careful what you ask for."

Water Family wrote on May 15, 2008 12:32 PM:Okay... so who is going to watch the water and those in danger while the lifeguard leaves his tower to chase down someone to give them a ticket for a bottle or for smoking? Are they going to pay for Patrol Lifeguards in addition to the Water Lifeguards? It seems the City is too cheap to pay for more officers or for citation lifeguards... instead they want to put the public at risk by making those there to protect the public in the water issue citations like the police. Where are the police on bikes?

Having lifeguards issuing citations doesn't put anyone at risk. Lifeguards aren't even in towers in the winter time and everyone seems to get along just fine.

Lifeguard supporter wrote on May 15, 2008 8:49 PM:Working for another lifeguard agency that does cite for infractions, I can tell you first hand that watching the water always comes first. Tickets are written only when the water coverage is adequate and the offender has been warned. Usually a stern warning and call to the police is all it takes to stop the unwanted behavior. Let the lifeguards do what they need to do to assure everyone a safe and enjoyable day at the beach.

osider wrote on May 15, 2008 9:30 PM:the primary job for the lifeguard is to watch the water. and the tower guards would not be the one writing the citations as it says in the article only the chiefs captain and lieutenant can rite citations. so you are not putting anyones life at risk because there is definitely someone watching the water.

No cops in their cute short pants riding 4-wheelers, no structure and seldom a problem. My oh my have times changed. I haven't been to the beach in 20-years, and I am glad I have a pool in my backyard.

This takes away from the regular calls for service! Why don't they just send them to the police academy and have a sworn officer in the river bed. I'll tell ya why! This code enforcement officer doesn't have to go thru a background, nor does a life guard. They don't have to be police officers and the city can pay them less. It is really stupid to be in the river bed as a code enforcement officer and or a life guard on the beach with out the protective equipment and training that police have, and still be responsible to enforce the law! Nopt good! It is just another law suit waiting to happen! That is why Oceanside is getting sued all the time! Who is at the helm in City hall! Why Rocky? Why?
