A professional surfer suspected of drunken driving in a June 6 car accident in Del Mar that killed his passenger is in good physical condition, hospital officials said.

Milton Willis, 51, of Solana Beach, survived the crash that killed 24-year-old Bradley James Dillahunty, a musician from Laguna Niguel. He was taken to Scripps Memorial Hospital La Jolla.

Sheriff's Sgt. Randy Webb called alcohol a "major factor" in the accident, but said Wednesday that investigators are waiting for results of toxicology tests before they make a final report to the county district attorney's office, which will decide whether to file criminal charges against Willis, who authorities said was driving at the time of the accident.

Willis was the driver of a Toyota sedan that damaged several parked cars and hit a large palm tree on Coast Boulevard about 1:40 a.m. on June 6, officials have said.

Witnesses told investigators they saw the Toyota traveling more than 65 mph in a 25 mph zone, Webb said.

The sedan blew through a stop sign at 20th Street, bottoming out in a dip in the intersection and causing Willis to lose control of the vehicle, Webb said.
