OCEANSIDE: Caltrans suspends Adopt-A-Highway program

Spokesman says action has no connection to Minutemen suit

OCEANSIDE ---- The California Department of Transportation has suspended its Adopt-A-Highway cleanup program at a time when the San Diego Minutemen, a controversial, anti-illegal-immigration group from North County, is waging a public battle over its right to participate.

Caltrans officials decided earlier this week to re-evaluate the program's guidelines, spokesman Steve Saville said Thursday. Until that review is completed, the agency won't accept new applications or process pending ones.

Companies and groups already enrolled in the program won't be affected, he said.

Saville declined to say how long the review will take or how many pending applications would be affected.

Roughly 4,000 groups have adopted stretches of road under California's Adopt-A-Highway program, which recognizes its volunteer participants with roadside signs.

Saville insisted that the decision to suspend the program wasn't prompted by a specific incident or the interest of any particular group.

But some found the timing suspicious.

The San Diego Minutemen, a group that has gained wide publicity for protesting day-labor hiring sites, is fighting Caltrans in federal court over its right to adopt a stretch of busy Interstate 5, near the San Clemente Border Patrol checkpoint.

"It's hard to believe its merely a coincidence," said David Blair-Loy, legal director of the American Civil Liberties Union of San Diego and Imperial Counties, which has supported the Minutemen's right to adopt a highway.

"It certainly seems to be in violation of the spirit, if not the letter, of the First Amendment to close down a forum for speech," Blair-Loy said, yet "I welcome the review to the extent that it may lead to the correction of unconstitutional language in the guidelines," which states that applicants who advocate violence or discrimination are ineligible.

Caltrans made national news in November when it granted the Minutemen permission to clean the two-mile stretch of I-5. Immigrant-rights activists said the Minutemen shouldn't qualify.

California Assemblywoman Lori Saldana, D-San Diego, said last month that she wanted Caltrans to refine its application procedures to require a membership roster, a board of directors and bylaws.

In January, Caltrans officials removed the Minutemen's stretch of road from the cleanup program altogether, stating that the presence of the controversial activists along such a busy stretch presented safety concerns.

They offered to shift the group away from the checkpoint, to a less-visible stretch of Highway 52.

Instead, the Minutemen sued to get the original site back and applied for a different stretch of I-5, just a few miles south.

Caltrans rejected that request last week, stating that it had already been promised to another group.

Jeff Schwilk, founder of the Minutemen, has accused Caltrans of deliberately trying to keep his group's sign off the side of the road. In an interview Thursday, Schwilk called the decision to suspend the entire program Caltrans' "nuclear option."

Saville said the segment of Highway 52, near Santee, is still being reserved for the Minutemen.

This is soooo unconstitutional. The Fed Courts need to step in and stop these bad legislators from hijacking our CA govt.

Seems like a lot of hassle to have a board of director, roster and by-laws, just to clean up a damn HWY.

Well we can Thank Ms. Saldana for California and Caltran's having to use taxes to clean hwy's now instead of the great program that got the hwy's cleaned for free.

I have to say Ms. Saldana appears to be representing the wrong group of people, if you get my drift.

This when the state of CA is facing a $15 BILLION deficit.
