OCEANSIDE: Judge orders Minutemen's Adopt-A-Highway permit reinstated
By CRAIG TENBROECK - Staff Writer | ∞
OCEANSIDE ---- A federal judge on Friday ordered the state Transportation Department to let a controversial group of anti-illegal immigration activists pick up litter near a Border Patrol checkpoint.
In a 34-page order, Judge William Q. Hayes granted the San Diego Minutemen's request for a preliminary injunction that gives Caltrans 30 days to reinstate the group's Adopt-A-Highway permit for a 2-mile stretch of Interstate 5 near San Clemente.
The state also must restore the courtesy sign bearing the Minutemen's name, the judge ruled.
The judge's decision enables the North County group to once again pick up trash alongside the busy freeway while its lawsuit against Caltrans officials is pending.
"We expected that on all counts," said the Minutemen's attorney, Howard Kaloogian, when he learned of the judge's decision from a reporter Friday night. "This basically tells us that our case is solid and will probably win on the merits."
The state's Adopt-A-Highway program allows individuals, organizations and businesses to clean stretches of roadway that meet certain safety standards. The groups are recognized with simple roadside signs.
In November, Caltrans made national news when it granted the Minutemen, a group that has gained wide publicity for protesting day-labor hiring sites, permission to clean the northbound stretch of I-5.
Immigrant-rights activists and some state legislators complained. In January, Caltrans revoked the Minutemen's permit, citing safety concerns.
The agency offered to relocate the group to a less-visible stretch of Highway 52. Instead, the Minutemen sued to get the original site back. The group's attorneys accused Caltrans of caving to political pressure and violating its members' free speech rights.
In March, Caltrans removed that stretch of I-5 from the cleanup program altogether.
In granting the preliminary injunction, Hayes determined that the activists have a "high probability of success" on the merits of their First Amendment claim and said it was in the public's interest to grant the injunction.
Hayes said Caltrans' justification for revoking the permit was "not reasonable." There is "little, if any, evidence" that the Minutemen's participation would endanger the public, he said.
Caltrans attorneys had asked the judge to dismiss the Minutemen's lawsuit. While Hayes dismissed the agency as a defendant, he did not do the same for its top officials.
Caltrans officials could not be reached for comment late Friday. In a court hearing in May, Caltrans attorney Jeffrey Benowitz argued that because the Minutemen could apply to clean up any other stretch of road in the program, they "have been denied nothing."
Last week, Caltrans suspended all new Adopt-A-Highway applications. The agency announced that it was re-evaluating the program's guidelines.

we never had day labor sites until third world illegals created them. we need to shut those trashy sites down. they should be illegal since everything is under the table.
why would a minuteman loiter around in front of home depot waiting for work? they're either retired from working at a REAL job for a REAL company or they're still working for that company.
there are those who are honest and dignified, then there are illegal aliens.
calling them immigrants is ignorant. an immigrant is someone who came through the right way, went through the background checks and health screenings and became an american citizen. what we're talking about are criminals who broke our laws by coming here illegally. HELLO!

The 'state legislators' the above article refers to are in fact the CA Latino Caucus headed by Gilbert Cedillo and Joe Coto, who along with Lori Saldano and other Latino legislators and even including the Mexican Consulate. These people, who seem to be more interested in protecting Latino's and Mexicans vs. acting on behalf of ALL Americans, regardless of race, received a wake up call from Judge Wm. Hayes that these types of Constitutional abuses of American's rights will not be tolerated. In court documents, it's revealed that these people along with illegal alien activist Enrique Morones, did slander and defame the MM by referring to them as racist, violent and discriminatory, all of which were proven untrue in this most recent and high profile ruling. What is truthful however, are the facts that illegal aliens from Mexico are regularly preying on Americans as proven by the many documented cases of murder, rape, robbery, drugs, etc. that fill our news and internet outlets and on many of our nations Ten Most Wanted. Go ahead, Google the Ten Most Wanted in some major S.W. cities, if you don't think this is true. Thank you Mr. Schwilk, Atty Howard Kaloogian and Judge Wm. Hayes for this very important, precedent setting ruling that will have national import and impact.

Thank goodness the Bush II administration has at last begun the enforcement of existing federal immigration law. This enforcement aims to stop the unscrupulous employers from their unlawful practice of hiring illegal aliens. With no job, the illegal aliens will self-deport (at their own expense) -- no national roundup necessary. Minus the lure of a job, the foreign nationals will not illegally migrate to America -- reducing the need for an expensive U.S.-Mexico border fence. Its a right and wrong issue, not a racist issue!!!
Cardiffian wrote on Jun 29, 2008 10:29 AM:Jeff, I have to agree with you. While I will never be able to support the minutement in their current form, I would certainly be more open to them if they spent more time busting employers than worrying about Caltrans did to their little egos. It seems that they are interested in only one side of the issue - the individual alleged illegal. I find it humourous that a poster claims that there are no immigrants at day labor sites, only illegals. That guy must have access to one heck of a database to support that claim! So come on MM, live up to your hype and bravado and go after some midwest meatpacking company, or go to a construction site and give the builder a hard time. I think you'd see an increase in your cause if you just applied some brains to the effort!

I'm wondering, where does it say in the Constitution that anyone has a RIGHT to clean up trash on the freeway?
I guess you just don't get it. This wasn't about a spcific part of a freeway and picking up trash. This was about the bigger picture of the Mexican consulate, the Latino Caucus and the pro illegal alien activist (Morones) getting involved to take away American's rights! Interferring and threatening to "Take down" a government entity , Caltrans.
It could not be allowed. Thank you to the MM!
To Roberto wrote on Jun 29, 2008 12:34 PM:I am not a "xenphobe"! Whether I belive in the MM or not it their right to choose a highway as everyone else did. As I see it they are volunteering their time and money. What are you doing? Sitting here and complaining. All talk and no action. I am sad to see that you put down Americans without a college degree. God blessed you with a brain to achieve it. What about others that don't have your capacity. Whether you are a ditch digger, as my Dad was who supported 6 children with a junior high education or a brain surgeon, why do you feel superior over others. What God has given can be taken away!
Sleeping Giant wrote on Jun 29, 2008 4:51 PM:Finally, a glimmer of hope for the American dream.
I don't think people realize just how bad things are due to illegal immigration. The more the Minutemen are in the press, the more people will be aware.
We are about to fall into the abyss. Time to make a stand people.
GO MINUTEMEN!
Go MM wrote on Jun 29, 2008 8:05 PM:Us Americans are tired of foreigner coming here and calling us racist. The foreigners convinced traiters at Caltrans to violate the constitutional rights of American. Thank you, SD Minuteman for the fight for right.
Roberto wrote on Jun 29, 2008 8:25 PM:Well, At least now I understand "I'm not a xenophobe"...your afraid of the job competition from illegals. You are the exception as this blog is a cesspool of bigots. You don't see them demanding drug interdiction which is caused by the demand for illegal drugs here or the war in Mexico as a result of it...Insuring workfare instead of welfare, no WIC and job training for all released from prison is the answer.....Let's call a spade a spade..the bulk of Xenophobes demanding front and center for the bigoted mm and vexant litigious whiners demanding free speech...lol! Just like this blog is censored, so should the bigoted racist mm.
strawberries wrote on Jun 29, 2008 8:32 PM:If the Minutemen adopted the section of Interstate 5 in Carlsbad next to the Encina power plant, they would be in a position to directly harass the Mexican boys picking our strawberries. Or maybe they would volunteer to fill a few baskets themselves?
doesnt matter wrote on Jun 29, 2008 9:27 PM:It really doesn't matter where or how these Minutemen guys protest. They will still never be able to rid Southern California of people who look Mexican. Their prejudice will never be satiated. We will always be a border community. Find something else to hate.
