ENCINITAS: City Council race is one to watch

Balance of power could be up for grabs

ENCINITAS --- Despite its catchy ring, Encinitans will not be hearing the slogan to vote for "Stocks and Bond" in November when they go to the polls to choose three candidates for City Council.

One-half of that pair, two-term incumbent Jerome Stocks, will be running for re-election, but after four terms and 16 years on the council, James Bond has said he will not.  

The other two-term incumbent, Maggie Houlihan, said she will make announcement about her intentions as soon as next week.

The election is pivotal for the city, because the outcome could mean a shift in the balance of power.

"It is going to be an interesting election because Encinitas is basically split down the middle with traditional Democrats and traditional Republicans each holding 50 percent," said local political watcher Mike Andreen.

Bond, Stocks and Councilman Dan Dalager make up the conservative block on the council; Houlihan and Councilwoman Teresa Barth are viewed as more liberal. Stocks is now serving as the city's mayor; the largely ceremonial mayor's post rotates annually among City Council members.

"The history of elections in Encinitas is that every four years it goes back and forth like a pendulum," said Andreen, who has been a campaign consultant for Stocks, Bond and council challenger Robert Nanninga. "Four years ago, the voters went conservatively and now, everything is shaping up for them to go liberal or Democratic."  

Candidates have until 5 p.m. Aug. 8 to signal their intention to run by filing papers with the City Clerk. If, however, an incumbent does not file for re-election, the deadline is extended automatically (for all non-incumbents) until Aug. 13, according to the state's election laws.

It appears the seat being vacated by Bond is where the real battle will be fought.

". .. This election is really important because whoever gets the third seat will be the swing vote and determine the city's direction for the next four years," Andreen said.

As of last week, Cervone said, six people had pulled papers to run for council:  Nanninga, Tony Brandenberg, Rachelle Collier, Doug Long, Joe Sheffo and a relative newcomer, dentist Harriet Seldon.

Brandenburg, a judge, has been a North County resident for almost 50 years and lives with his wife and two children in Olivenhain. His legal career has included more than 16 years on the bench in the Municipal and Superior Courts in Vista.  In 2004, he retired from the Superior Court, and was appointed as chief judge of the Intertribal Court of Southern California.

Collier has been on the Board of the Leucadia Town Council since 2001 and its president since 2006. She is also secretary of the Leucadia 101 Mainstreet Association. Collier said that she wants to keep Encinitas livable, while acknowledging the unique qualities of each of the city's five individual communities. She also supports the Sunshine ordinance to restore trust in government and community involvement and is endorsed by the California Sierra Club and the League of Conservation Voters.

Long attended Encinitas elementary, junior high and high schools before joining the Marine Corps. He has worked with the Encinitas Optimist Club, the Encinitas Holiday Parade Committee, the city's Sister City Committee and the Downtown Encinitas Mainstreet Association. In 2003, he was appointed to the city's Parks and Recreation Commission and was voted chairman of that commission in 2005. He is also a member of the Encinitas Rotary Club and owns his own local plumbing repair business called Bert's Plumbing.

Nanninga, a local activist and freelance writer, is co-owner of the E Street Cafe in downtown Encinitas and has served three terms as Encinitas Parks and Recreation commissioner. He also has written an opinion column for the Coast News since 1994. An outspoken advocate for local environmental issues, Nanninga is the founder of Encinitas Environment Day and serves on the city's Invasive Species Subcommittee. Having run unsuccessfully for City Council twice before, Nanninga says the difference this time is that he is not simply running on one issue.

Sheffo is a former assistant opinion page editor for the North County Times. He previously worked as an aide to Supervisor Pam Slater-Price and to former state Assemblyman Mark Wyland. Sheffo has consistently opposed raising fees and taxes, saying that government should find more ways to make ends meet before resorting to tax hikes. He also said he would like to work to preserve and expand Encinitas' system of trails, parks and open spaces and to protect the coastline.

Seldin is a dentist who lives in Encinitas and works in Clairemont. She was appointed by the governor to the Dental Board of California in 2005 and was a past president of the San Diego County Dental Society and Health Committee Chair of the Regional San Diego Chamber of Commerce. A founding board member of Padz (People and Dogs Zones), she said she supports dog parks in Encinitas, including the development of the long-planned dog park on the Hall Property.

Once the filing period closes in August, the candidates' names, occupations and statement of qualifications must be filed with the Registrar of Voters. The ballots are then typeset, proofed and printed in mid-September with sample ballots mailed to registered voters between Sept. 25 to Oct. 14. Election Day is Nov. 4 this year, with polls open from 7 a.m. to 8 p.m.

Council members are paid $1,186 per month during their four-year term.

While, I'm considerably under 60, I don't hug trees, I voted for Stocks in the past; he very well may be awesome but I too feel it's time for him to go. If he has aspirations for higher office, now is the time for him to act on it. He's been here too long. Time for a fresh look, new set of eyes, and all that. Besides, a swing in the other political direction is not a bad thing right now.

Under the current leadership, Encinitas is one of the richest cities in not only the county but the state as well. And home prices are much stronger here than in other cities. Encinitas is desirable in so many areas, so I believe that the status quo must be doing something right.

There will always be naysayers, and the power of the Internet gives them a voice. But I believe the average Encinitas resident will look at the facts, not opinions, and vote accordingly.

The city is considering spending 20 million on tunnels under the train tracks, yet many of our town's streets don't have the most rudimentary sidewalks. Most of the sales tax revenue for the city is generated east of I-5, yet the council repeatedly ignores the wishes of inland neighborhoods and businesses (eg the rapid approval of the Walgreens on El Camino Real). I'm very concerned about having three Leucadians on the council, when the issues surrounding the Scripps hospital expansion and the Hall property park have a lot to do with the absence of adequate road infrastructure in the Cardiff area. I'm confident that Theresa Barth will represent the needs of South Encinitas, but what about the others?

Keith wrote on Jul 28, 2008 8:02 PM:Barth and Houlhan worked much closer with Superintendent King and the consultant for the school district, Dee Snow, than the three men on the council.

Mayor Stocks should agendize a meeting immediately to find out how much the city could pay for the Pacific View campus and turn it into a city park. 25 cents to the dollar is a great savings to the city.

As for EUSD, once again their leadership has shown an inability to work in concert with the city. Trying to trick the city council into changing the zoning of Pacific View only to immediately swap the parcel to a developer is frowned upon by honest people.

As for me, I think Stocks has not served us well, and we need open-minded people who will listen to the community. I hope for some candidate forums so we can hear all the new candidates and make informed choices. This election truly does matter.

Political party does not and should not matter in being elected to the Encinitas City Council. It is actually more about developer funded candidates and interests vs. community grass roots candidates and protecting the city that we have against over-development.

John E wrote on Jul 29, 2008 7:19 AM:As a proud member of America's centrist plurality, I resent Mike Andreen's characterization of Encinitas being 50% Republican and 50% Democrat. Registered independents comprise at least 25% of our local electorate, and many of us who register with a major party are independent swing voters at heart, but do not want to be disenfranchised during the primary election. Fortunately the City Council race is non-partisan, as I wish all political contests were.

So far, I am very pleased and honored to endorse Rachelle Collier's candidacy without reservation, and I shall happily vote for Houlihan if she indeed runs for re-election.

Remember a key issue that seems to be overlooked is the fact that Mr. Stocks was a principal in touting that the Mossy Property was a "turnkey" property. There was but a single appraisal, in reality it allowed Phil Mossy to line his pockets and Encinitas continues to pour money into the building. Also, the use of the San Dieguito Water District as a private piggy bank for the council has got to stop. An independent board has to be elected, we do not know how much money has been borrowed from the district via bonds. The council members either don't know or are unwilling to share this information. A new council would likely call for a new city attorney and planning department manager. Both Glen Sabine and Patrick Murphy along with staff have done significant damage to our city.

Jerome Stocks our representative on NCTD keeps saying that is all we can have even though throughout the country and the world they have at grade pedestrian crossings. The state of Oregon just completed two new at grade crossings for 50 thousand each. Regarding Walgreens, about half of the audience that attended the June 25, 2008 City Council meeting were from the coast and were there to support the 17 speakers(some of whom are coastal residents) regarding the traffic mitigation proposal.

Jane wrote on Jul 31, 2008 12:10 PM:I was not notified about the Pacific View Planning Commission meeting last Thursday, although I had been to, and signed up to receive notice at two previous meetings, one at Paul Ecke Central School, and one at Oak Crest.

I have consistently maintained that as the school property was DONATED for public school use, that it could become a POCKET PARK. The superintendant is irresponsible to want to put more high density development in our neighborhoods, when this could be avoided. I'm glad for those concerned citizens who are following through on this.

Job wrote on Jul 31, 2008 12:15 PM:Tony Brandenburg, a candidate is not a retired judge, and technically was never "on the bench." He is a retired commissioner, never a Superior Court Judge. "Tribal Judge" is a voluntary, unpaid position, and should read "Community Volunteer." State Election Code Section 13107b forbids misleading designations. Heads up NCT!

He was sought out for this position because he was most knowledgeable about Indian law as it relates to state laws - that knowledge came from his PRIOR pro bono work for the Hopi Indians in Arizona over the 20 years PRIOR to accepting the Chief Judge position. He is not a volunteer - although he does the work because it is in his heart. District Attorney Bonnie Dumanis recognized him as Chief Judge at the new courthouse grand opening, both in her speech and by her presence - as did other representatives of state and local agencies.
