OCEANSIDE: Overcrowded homes in council's cross-hairs

OCEANSIDE ---- Apartments and homes crammed with people are creating tension in some Oceanside neighborhoods, according to City Council members, who took an early step this week to confront the issue.
At Wednesday's meeting, the council directed the city attorney to present them with options in three to four months for dealing with crowded homes.
In some neighborhoods, Councilman Jerry Kern said, "We have two or three or four families living in a house. We have seven, eight, nine cars parked around."
Many California cities are struggling with overcrowding, which is often linked to the immigration issue.
Addressing it can be tricky.
"We really face issues with regards to occupancy limits," City Attorney John Mullen told the council. "Those are set by state law, and generally, we're pre-empted from regulating that area."
Sometimes, cities will work around the perimeter of the issue. In the next month, the Escondido City Council will consider an overnight parking ordinance that some officials say is an attempt to curb overcrowding in the urban core.
Oceanside Councilman Jack Feller urged Mullen to explore all options.
"We maybe need to be the one that's on the cutting edge of trying to make this a public health and safety issue and stop this madness, because we're getting complaints every day," Feller said.
One north Oceanside resident, who asked not to be named, told the North County Times on Thursday that at least nine men live in the home across her street.
"It's like a flophouse," she said.
The post office has threatened to stop delivering her mail because cars are constantly parked in front of her mailbox, she said. And the neighbors' house has fallen into disrepair, she added.
"Bring on the ordinance," she said. "I'm so ready for it."
Wednesday's discussion started with Councilwoman Esther Sanchez's suggestion that the city do something to prevent mini-dorms ---- single-family homes with added bedrooms that are rented to students.
With the Sprinter up and running, she said, students are likely to start pooling funds and renting homes in Oceanside neighborhoods.
Local college are experiencing high enrollments, she said.
"They're going to have more students, and less places to live," Sanchez said.
Cities such as San Diego and San Marcos have passed mini-dorm laws that limit the number of allowable leases within a single-family home, Mullen said.
But Kern had more on his mind than just college students.
"I'd like to take a look at the whole global problem (of overcrowding) other than just the mini-dorm problem," he said.
Feller recalled visiting a two-bedroom apartment with the Oceanside Jaycees a few years ago to drop off Christmas presents. Six adults and 12 children lived there, he said.
"Your heart aches for those children, but something is wrong with the system that allows that to even occur," he said.

Go into the neighborhoods of Eastside, Crown Heights or Mesa Margarita, and it's glaringly obvious there are too many people crammed into the small homes and apartments. There are cars parked on front lawns, side yards and on every available space on the streets. There are illegal garage conversions, and room additions that are clear signs that overcrowding is a problem. Take Crown Heights for example, there are passenger vans lining both sides of Division Street, clearly used to transport the many migrants who live in the neighborhood. Eastside and Mesa Margarita have several homes with garage conversions and homes with cars parked on lawns.
Overcrowding is a result of several things, but is due in large part by our burgeoning immigrant population, who oftentimes live with extended families, and/or rent rooms to other immigrants. One thing we ignore is the homes that have adult children still living at home when they should have moved out long ago. Maybe this is a cultural phenomenon, but I think it's a by-product of the scholastic under-achievement and the high dropout rate that is so pervasive in the Latino community. Subsequently, too many Latino adult children are either not gainfully employed, or are in low-skilled jobs and cannot afford to live on their own.
Both of these scenarios are socio-economic realities that are the main underlying causes of overcrowding. The city code enforcement officers will have their hands full trying to correct the problem, something that has gotten increasingly worse over the past couple decades. The time is now to deal with overcrowding, which will produce other benefits such as reduction of gangs, crime and violence.

Some of the trailers even have add-ons like Tijuanita shacks, and a bunch of cactuses around the fences with pit bulls guarding. One house was just rated about 2 months ago with drugs by Vista sheriffs and there are still living there. Have any of these counsel members ever heard of the words, “illegal immigration?” Sorry Feller your heart should be breaking for us the homeowners that have to live under these conditions. Get on with the program and start taking care of the Oceanside citizens and taxpayers.

they should... wrote on Aug 14, 2008 10:02 PM:have started attacking these issues County wide years ago, during the big build up of the cost of homes and zero-down mortgage loans, banks were writing and okaying loans to people who in the REAL world could in no-way afford the loans they were taking out, as the costs go up, they've often resorted to bringing extended family, other families, and boarders to help pay the over-inflated payments, these extra "residents" take up parking on the streets, and the homes and neighborhoods start going downhill.
Now if any municipality wants to enforce their City Codes, they risk being accused of going after certain ethnic groups, calls of profiling and rascism, simply because they are attempting to enforce codes that should have been adhered to, rather then being ignored.

my city wrote on Aug 14, 2008 10:39 PM:The city should go in to some of these hovels and cite as many people as possible, but I think we also have to recognize that we're partly responsible for creating this mess. The 1950s ideal of single-family homes on 1/8-acre lots isn't always realistic nowadays. Why don't we burn down one of these neighborhoods and replace the houses with three- and four-story apartment buildings?

Typical scenario, multi-families (and annoying dogs) living in single-family home. How are you gonna prove that? Ask them? Sure, they'll tell you what they're doing...HA HA HA.
Other than the talking to the owners/renters, what's the city going to do? People are under no obligation to show code inspectors identification or prove their residency. What if they just walk away when the inspector shows up and come back after he/she leaves? How are the officials going to know who belongs where?
From my experience living NEXT to such a place, you're just swimming upstream trying to use the codes to enforce such requirements. The city code guys get tired of dealing with it after awhile, your neighbors figure out who's complaining and the sheriff's dept is useless in such situations. Do what I did...MOVE! I know that's not much of an option but at least I have peace of mind now.
Yeah write all the rules...they don't mean squat if they're not enforced. If its any consolation, I was reading some history book a while back and I read about some guy who was sick of his Irish neighbors because they had multiple families in a single family apartment...back in the 1800's. So we're not the first to deal with this issue.

I've lived in Oceanside for 25 years and I don't want to move, but we are starting to look like Escondido and Santa Ana - overrun by poor "immigrant" families who probably shouldn't be here in the first place. I've hear too many stories of what happens to the children when you mix a bunch of kids and a bunch of adult men in a 3 BR house. Take a guess.

But, a complaint during city council, may or may not get attention. Written complaints, with attached documents, mailed via registered mail, return receipt requested, get action.

It appears the only way, as adopted by dozens of California cities, to curtail the overcrowding is through restricted parking. Cities can make parking in front, rear and side yards a violation of code. Do it. Enforce it. California law allows cities to ban overnight on-street parking. Do it. Enforce it.

I too have made complaints of cars being parked on front yards. As we all know we pay real high property taxes,for what to look like TJ. Some days can't even park my own car as,NO where to park in front of my own house. And the up keep on these homes is discussting... It's bringing us ALL down,as mentioned on here. HURRY up Oceanside,who are suppose to be in charge...

It is called grandstanding before an election. Feller and Rocky are looking for issues that really irk citizens and use Kern as their frontman. The Escondido Council have been adressing these same issues and many others associated with the illegal immigration and overcrowding. Kudos to Escondido council for listening to their legal citizens. Our council is more focused on taking care of Mitsubishi/Robertsons and Asphalt companies. Oh lets not forget the Surf Museum and other redevelopment giveaways. The millions of dollars of redevelopment money is bieng diverted from your neighborhoods to downtown while our areas suffer. Redevelopment needs to pay back the millions it owes to be used to hire more code enforcement officers and other services.
We basically gave the Surf Museum a million dollars in a recent council giveaway. So don't be tricked by this council it is just political grandstanding before an election or maybe Rocky, Jerry or Jack might have acquired one of those overcrowded homes in their neighborhood.

When is Vista going to get off their butts & tackle this same problem? Been happening here for years. Why bother to have & pay for a Code Enforcement Dept.? Multi-families continue to live in R-1 zoned neighborhoods, trailers & cars parked on lawns, permanent debris & trash in yards---you name it! City regulations forbid all this but they remain, in spite of complaints made to the City.

Esther Sanchez has her head in the sand if she thinks these are mostly students in "mini-dorms."

Something has to be done about the overcrowding. It's not just the immigrants that are living like this. My (white)next door neighbor who is from Kentucky had his brother and his 2 kids living in a camper in the back yard. The brother and his children left weeks after we confronted them about the smell of marijuana coming from their camper.The yard also looks like a junk yard! There are too many people converting their garages illegaly becuase it's just too expensive for them to do it legally. These people should be fined.

I find so many NCT forum users so quickly stoop to baiting Hispanics. I suspect ICE isn't bothering with most of these overcrowding houses because the residents **aren't illegal!** Chill out people, these folks are only guilty of being poor! Wages are low, housing prices are high, and with the housing bubble bursting and rampant foreclosures, you're going to be seeing more and more multi-family whites in the same situation.
There's already channels that diligent neighbors can use to combat loud dogs, parking gone awry, and public health concerns. Take the time and use them!

All their cars leak oil and are parked on the front lawn and in front of the home and across the street (seriously, 15 to 20 cars for one home). The street degrades from all the oil, the cars look getto, and it should be illegal for cars to be parked on the front lawn. There's a green house on Maxson Street that is a shining example of this scenario. Property values suffer because of these type of people. I hope and prey our City Council will do something about this. I'm really looking forward to November.

I moved from my Vista home of 14 years because of all the overcrowding. Three houses next to us had their garages converted and there were cars parked everywhere. I complained to the HOA but they said that Code Enforcement had to enforce the laws governing this. Code (lack of)Enforcement said it was the HOA who had to step in. Nothing having been done, I relocated to where I no longer have that problem, yet.
I don't care where these people came from, their financial problems or whatever. I just want density laws enforced and code enforcement to do their job.

I've owned rental properties in other cities and states, both single family homes and multi-family apartment buildings. We had occupancy codes based on the square footage, number of bedrooms and bathrooms limiting the number of people and animals allowed to live there. Most of the time, it was to protect antiquated sewage systems. It protected the land owner as well because most of the time we paid for water and obviously 12 people living in a home or apartment use way more water than a family of four. Occupancy laws protect everyone except the people who want to create mini-dorms. I cannot understand why it is so hard for Escondido and Oceanside to institute such restrictions. And, the cities and states I've had rental properties in were not plagued by illegal aliens, so there was no charge of targeting one ethnicity...

A study last year found that there are about 250,000 illegal aliens hiding in our county. Out of 3 million total. That's 1 out of every 12 people living here is here without PERMISSION. Just think if all those folks decided to become law-abiding citizens and return to their home countries. Overcrowding problem SOLVED. Water shortage prolem SOLVED. Traffic gridlock SOLVED. Wake up people. Many of our problems are caused by mass illegal immigration, overcrowding, and over population (guess who have 4 times more children than Americans?). Lets try enforcing ALL the laws and see if our communities improve a little. I'll bet you 1000 pesos things get a lot better real quick! They already are in places like Esconidido where they are cracking down.

If youdon't have a permit, you can only park for 2 hours, something like that. They should be interviewed and have the proprty checked out and if they are living according to the law, they get a permit. If not, they have to park somewhere else and walk to the house. they are really bringing property value down and not pying their fair share of taxes and other city/county charges for sewer, trash pick-up, etc...It needs to stop and be cleaned up. Give the neighborhoods back to the honest, clean-living people.

To be exact on Tremont St. Way before they started building all these new beach condos I already had problems with the houses around me that are mainly rented/ owned by WHITE people being overcrowded. As you may already know these homes are maybe 1100 sq feet each and they have about 3 families in them because they want beach view. Way TOO many cars for our street with these extra bodies in these homes. To make matters worse the movie theatre makes parking on my street almost impossible sometimes. Stop trying to blame all overcrowding on LATINOS. They are not the only ones over populating our homes or cities. People always want to point he finger to latinos when *hit hits the fan. Mostly every home or apartment has one to many people in there.

I believe they have some sort of permit parking system that limits the cars the residents have on the street and keeps the apartment dwellers off. You may want to check with the City of Oceanside Traffic Department or your OCNA neighborhood group of what you can do. Don't give up. There is a solution hopefully.

On the other hand, there are houses where it's obvious that illegal immigrants are living there. There are 10-12 people living in these houses and the owners are even renting out the garages as living quarters. These people also come with many children which is putting more stress on our public schools. I'm glad my children are already through the public school system in Oceanside.

Health concerns that are one of the biggest reasons for zoning laws. Having too many human beings in one residential neighborhood creates a breeding ground for infection and facilitates the spread of disease. (I can only imagine the filth and unsanitary conditions that exist in overcrowded residences.)
If those who are against zoning laws look at third world countries they'd see why we have laws in place. We don't want to turn into Mexico or any other country that allows overcrowding or has no zoning laws. Economic disparity is no excuse, and if people are too poor to live in an area, or can't live within the law they need to find alternative places to live or face the consequences.
And, since many illegal immigrants work under the table (cash and carry), and don't pay taxes, they still use our public roadways and streets at no cost to them. Yet taxpaying citizens are inconvenienced or unable to utilize the resources they help pay for.
What city code enforcement officials need to do first is attack the problem of illegal garage conversions, room additions, and parking on front lawns and yards. Parking on yards allows hazardous fluids from vehicles to pollute our ground water. Paving front yards doesn't allow water to soak into the ground and forces sewer systems to handle more runoff.
Then they need to address the public health issue of trash and junk that exists on people's yards. On-street parking needs to be restricted and controlled. In the city I grew up, on-street parking was prohibited from midnight to 6 AM. We didn't have multiple families living in one home and most people had garages and no more than two cars (generally). While the City of Oceanside shouldn't be in the business of being a 'homeowners association' they need to have parallel limitations and restrictions.
As a taxpaying homeowner in Oceanside, I want to see action before my property value diminishes any further.

As I'm going through counting bedrooms, I get the back of the house, and it's really a 5 bedroom, 2 bath place. I'd never seen an 800sqft, 5 bedroom, 2 bath home before. Turns out not only was the garage a room, the patio had been enclosed, and another bathroom added. All it was missing was the pay-laundry! Which I actually saw in the garage of another similar place, right next to the mattress of the dude sleeping on the floor. Very eye opening stuff.

Streets were lined with run down houses (obviously rentals) and there was absolutely no parking. I also noticed that many of these cars jamming the streets had Baja plates. I now have no interest at all buying in O'side. Let it fall into the ocean for all I care.
As a side note: I am 1st generation American (all legally). I can only hope that people don't confuse immigrants with the aliens who refuse to acclimate to the US, refuse to use English, and illegally drive around in gross polluting cars. We are not the same.

I checked several tree trimmers recently before having a tree trimmed and three of them were using someone elses contractor number. This also means no insurance and no workers comp. One showed me fake workers comp papers. Pays to be careful should something go wrong. Cheaper isn't always better in the long run.

These barrios maintain the illegal’s previous culture and most importantly their unwillingness to learn the English language. So now our schools have to dumb down and cater to the children of these illegal’s.
That in turn effects all children in the school system.
Compare the performance of our schools to the developed world, it is pathetic.

'such were some of us' and 'but for the grace of God, there go I'. Our ancestors did it all then so that we could have what we have today.
The Bible says to 'love our neighbors as we do ourselves'. For all the love and compassion that has been exhibited here, it would seem that you all must not love yourselves or you do not have an appreciation or understanding for those who have struggled in the same fashion on your behalf.
