MURRIETA: City begins use of eminent domain on property

MURRIETA ---- The City Council decided this week to initiate eminent domain proceedings in attempting to obtain property needed to complete the Interstate 215/Clinton Keith Road interchange project.

Eminent domain is a legal process whereby a government agency can force a landowner to sell property at its fair market value if the land is needed for a public benefit.

The city has been attempting to negotiate terms for the purchase of the land near the interchange project site, city reports state.

Murrieta has offered the appraised value of $223,000 for the land, which is vacant, city records state. The property owner, identified as Kim Investments, has declined to sell.

While the council voted unanimously to begin the eminent domain process, negotiations with the property owner will continue, city leaders said during Tuesday's council meeting.

Throw them out wrote on Oct 9, 2008 7:45 AM:Take the land, they had their chance to sell. You don't get to hold the entire community hostage. You were offered a more than reasonable price, you wanted to play hardball; now you lose. Tough luck, I have no pity for greedy people.

Suspicious wrote on Oct 9, 2008 9:51 AM:I remember when Murrieta wanted to offer zero dollars for land, stating the increased value would be enough compensation. This offer seems reasonable. However, I remain suspicious of any goverment agency that uses eminent domain.

Wait a minute . . . wrote on Oct 9, 2008 10:33 AM:A few years back, using eminent domain was characterized by some of the current councilmembers as an abhorent abuse of governmental powers. I guess now that they actually have to make the decisions and be responsible for those decisions it's somehow different. At least they made the right decision.

I suggest have the property re-appraised and offer a lower purchase price.

Or, better yet, the City could just re-zone the property as habitat and offer it to the tree huggers thereby making it value-less.

Good plan wrote on Oct 9, 2008 12:59 PM:I'm all for giving it to tree-huggers; anything so I don't have to hear how it's going to be developed (what, are we going on ten years now with that old story?).
And, I don't think the owner is holding out for the love of the property; they want more money. Throw them out, they can go be greedy somewhere else.

This is important information that was discussed by the council and that should not have been left out of the article. Also discussed in the council meeting is that the developer is very close to holding up the final go to get the Clinton Keith bridge started, another important bit of information the article should have mentioned.
