OCEANSIDE: Man shot by police charged with six felonies

An man shot by Oceanside police officers in a confrontation outside his home last month has been charged with six felonies, including two counts of assault with a deadly weapon on a police officer, the prosecuting attorney said Thursday.
A Thursday press release by the Oceanside Police Department incorrectly stated that Gregory Kwok, 48, had been charged with three counts of attempted murder of a police officer.
Gregory Kwok, 48, pleaded not guilty to the two assault charges, two counts of resisting arrest, one count of attempting to take a service weapon from a peace officer, and one count of grossly negligent discharge of a firearm, prosecutor Kate Flaherty said.
In addition to those felony charges, Kwok also pled not guilty to one misdemeanor count of trying to harm a police dog, she said.
He faces up to 10 years in prison if convicted, she said.
Flaherty said Kwok's dog, which was killed in the confrontation, was perceived as a deadly weapon in the incident.
"He came at the police officers with a pit bull," she said.
Kwok was arraigned at his bedside at Scripps Memorial Hospital in La Jolla, where he had been recovering from gunshot wounds since Oct. 26.
Oceanside police Sgt. Kelan Poorman said officers interviewed Kwok for the first time this week and that he was formally arrested and read his rights Wednesday.
Kwok is in sheriff's custody at the hospital in lieu of $250,000 bail, Flaherty said. He will be moved to the medical ward of the Vista jail as soon as he is released from the hospital, she said.
Kwok works as a mechanic and lives with his 81-year-old father, Aubrey Kwok. On Thursday, Aubrey Kwok said he had no comment on his son or his criminal case because it was "a high-profile legal matter." He said no lawyer was available to speak for his son.
Police originally were called to Kwok's home on Lonnie Street after neighbors reported that Kwok and his father were arguing loudly, and that Gregory Kwok had fired a gun into the ground in the front yard, Poorman said.
When police arrived, Kwok allegedly ran inside his house and got his pit bull before coming out again. The man allegedly ignored three officers' commands to stop, instead rushing at them with his dog, trying to grab one of their guns. Two of the officers fired shots and one used a Taser, Poorman said. It is unclear how many times Kwok, who was unarmed, was shot.
One officer shot and killed the dog. None of the officers was injured in the confrontation. Poorman said a police dog was hurt slightly when the pit bull bit it.
The next hearing in the case is Jan. 6.

Since he previsously had discharged a firearm in his front yard, but then came back outside without a firearm I think the attempted murder charges shouldn't hold up. The police wasted his dog, but then couldn't contain him such that they felt sufficiently afraid for their lives when he was supposedly going for one of them's firearm, that one of them shot him, I don't buy it. It sounds like excessive force and the DA is covering as ususal.

As I have said before, your supreme court has ruled before that anyone who grabs hold of a police officers gun in his/her holster, it is attempt murder on the officer. Come on NCT, yes OPD requests charges to be filed but the DA can increase or decrease them as they feel fit. Your comment that OPD incorrectly stated the charges is just your way of putting fuel on the fire.

Is is common for OPD to shoot people?
I can remember lots of stories of SDPD shooting people (heck, the SDPD shot the woman here in Oceanside in the Lowes parking lot). And I have read al few stories about Sherrifs shooting people.
Have there been a lot of stories about OPD shooting people?? Can we get some facts here? How can we acertain if there is a problem if we have no facts?
I can see calling SDPD a little trigger happy, but does that apply to OPD??
ANYONE have any facts on this?

He's was arguing with an 81 yr old man for Pete's sake and then went outside and fired a gun. You don't think that was a dangerous situation?! If you don't expect that to happen, then you must be a criminal, too. The police are here to serve & protect law abiding citizens. That's what they did.
Let the courts sort out the rest.

We should be thankful that they're doing something about dangerous people in our neighborhoods, unles you're saying that behavior is acceptable to you.

Yes all in a days work, however the time he spends away from our family to attend meetings with the DA to prosecute these thugs, to go to trial several times on one case is beyond what he gets paid for. Why does he do this, to make our little corner of the world a little better. I am sure you won't like him because yes sometime the average Joe is going 90 miles and hour down the road is someone my husband will pull over. It's the other 99% of his work you don't see and when you do see it people pick it apart like they know what the hell they are talking about. It the holidays and where will you find my man, working.. Don't be so critial on these guys, just say thanks and move on.
