ESCONDIDO: Man shot by police faces drug, weapons and assault charges

ESCONDIDO -- A man shot and wounded by two officers Friday faces multiple charges, including assaulting an officer with a deadly weapon, pointing a firearm at an officer, possession and transportation of methamphetamine, and felony drunken driving, police said Wednesday.

Police allege that David Charles Phillips, 44, of Escondido, led officers on a chase and threatened them with a gun while under the influence of alcohol and a controlled substance.

A guilty finding on the drunken driving charge would be Phillip's fourth conviction for the offense within the last seven years and an automatic felony under state law, Benton said.

Phillips, who is in fair condition, has declined to be interviewed by police, Benton said. He is expected to be arraigned on the charges either Thursday or Friday in his hospital room.

Phillips could not be contacted at the hospital for this report.

Police investigators are not yet sure how many times Phillips was hit, Benton said. It can be difficult to determine how many entry wounds and exit wounds a shooting victim has, he said.

Benton said Phillips' case may be complicated by injuries Phillips suffered from broken glass after one officer fired at him through the windshield of his truck.

Benton said the department is not revealing the number of shots fired in the incident because investigators are still interviewing the other officers who were at the scene when the shooting occurred.

Investigators are only about halfway done combing Phillips' truck for evidence, Benton said. They are still waiting for the result of Phillips' toxicology tests, he said.

On Tuesday, the Police Department identified officers John Mougier and Edward Varso as those involved in the shooting.

Mougier is a patrol officer who has been with the department 23 years. Varso is a canine officer who joined the department seven years ago after three years with the Los Angeles Sheriff's Department, he said.

Both officers are on paid administrative leave, which is standard procedure following shootings, Benton said.

The incident began when officers attempted to stop Phillips at Del Dios Highway and Valley Parkway on suspicion of drunken driving at 9:57 p.m. Friday, Benton said. Phillips, driving alone in a pickup truck, fled, he said.

Officers pursued Phillips as he traveled on Ninth Avenue and Interstate 15, Benton said. Phillips exited at Felicita Avenue and headed west on Gamble Lane, he said.

Phillips crashed into a truck parked outside a house, drove down an embankment and got stuck trying to get out, a witness said.

Phillips allegedly pointed his weapon at the two officers who approached him, prompting each of them to fire his weapon, Benton said.
