NORTH COUNTY - A financial settlement has been reached in a lawsuit an Escondido rape victim filed against two attorneys who had represented her in a case against the landlord of the apartment complex where the rape occurred, attorneys said Monday.
The terms of the settlement are confidential, attorneys on both sides of the legal malpractice lawsuit said.
After she was attacked in 2002, the woman filed a lawsuit alleging the landlord failed to provide adequate security at the apartment complex. She was represented by attorneys Mark Kelegian and Thomas Morgan.
Kelegian did not show up to court for the trial of that lawsuit, and the woman learned the case already had been dismissed, an appeals court ruling stated.
The woman then sued Kelegian and Morgan for alleged malpractice, but a Superior Court judge threw out the case, prompting an appeal.
A state appeals court ruled the woman could proceed with her lawsuit against the attorneys. The state Supreme Court declined to hear the case.
A status conference for the lawsuit had been scheduled for Friday in the Superior Court, but the settlement was agreed upon about a month ago, the woman's current attorney said.
