SAN DIEGO (AP) - San Diego officials are for the second time trying to settle a lawsuit by the building industry challenging the city's affordable housing law.

A judge has already ruled the ordinance unconstitutional. It requires builders to include low-and moderate-income units in their residential developments or pay a fee instead.

Now the city is trying to modify the ordinance in a way that would satisfy homebuilders while nullifying the court action.

The proposed settlement closely mirrors one the City Council approved in April and then later rejected, according to Jim Waring, who oversees land use and housing issues for Mayor Jerry Sanders.

Under the compromise being discussed, the fee would be calculated earlier in the development process, meaning that many developers would be able to escape future fee increases that occur each year.
