VISTA: Man accused of killing pregnant woman pleads not guilty

Family angry that only one manslaughter count brought forward

VISTA -- A man suspected of slamming a car into and killing a pregnant Vista woman last week pleaded not guilty to all charges during a court arraignment Friday.

Mark Allen Davidson, 21, faces up to 18 years in prison if convicted on all charges -- one count of vehicular manslaughter with four enhancements for great bodily injury, five counts of reckless driving causing great bodily injury and two counts of felony child endangerment.

Family and friends of the victim, 19-year-old Nancy Canseco, expressed anger that only one manslaughter count was brought forward by Deputy District Attorney Brendan McHugh.

Canseco was nearly eight months pregnant at the time she was killed, family members said.

Her unborn child did not survive.

"Right now, we're really upset," said Veronica Lara, a friend of Canseco's family, as she and about two dozen family supporters left the arraignment. "He's (Davidson) taken two lives and he's getting only one charge of manslaughter."

McHugh explained after the arraignment that, under California law, a person cannot be charged with manslaughter in the death of an unborn child. Only in murder cases can such a count be brought forward, he said.

Davidson, a skinny man with a large gash on his nose, spoke briefly during the arraignment. Standing next to his defense attorney, Tom Kontos, he told San Diego County Superior Court Judge Marshall Hockett he agreed to plead not guilty and understood the charges against him.

Davidson, a Vista resident, was driving a 1968 Chevrolet Impala at more than 80 mph on Oct. 23 when he lost control of the vehicle and struck Canseco as she was walking alongside North Santa Fe Avenue at about 10:20 p.m.

She was just yards from her home on the 1500 block of North Santa Fe. She was pronounced dead at the scene.

Four passengers were in the Impala at the time of the crash, including two minor females, one male adult and one female adult. They, along with Davidson, were taken to local hospitals with injuries.

A 15-year-old girl was initially listed in critical condition following the wreck. She was is serious condition Friday in an intensive care unit in a San Diego hospital, said McHugh, the deputy district attorney.

Toxicology results are pending in the case. McHugh said there is no indication at this point that alcohol was involved in the crash.

Davidson, whose bail was set at $330,000, posted bond Oct. 24 and remains free.

The judge ordered Davidson to turn over his driver's license and to live with his parents for the time being.

He added that he is not to drink alcohol or leave his parents' home after 10 p.m. or face "dire consequences."

A trial readiness hearing in the case was scheduled for Dec. 12 at 8:30 a.m. at the Vista courthouse. A preliminary hearing was set for Jan. 9.
